I 140 From Jan 2005 - EB3

my ND for all 485,765,131 is 03/07/05 but LUD is 03/10/05. LUD means Last Updated Date. so by the time we get our receipts the date which is ND is updated. that means they did some work on your application after 03/01/05 i.e, on 03/03/05. these are only my thought. i hope it helps.

EAD got approved.......

hi guys,

our EAD got approved on 04/22 and LUD with message change is on 04/25. Now eagerly waiting for the progress in 140. any LUD's on !40 for anyone in this thread?

how can i enquire about that? Is there any way to do that? there in no message change on my I-140. so i don't know the reason. let us wait if it is normal some of u also get LUD's by the end of apr or in the beginning of may.

*** you can apply for EAD now, as it may take min 2-3 months for approval
even if she used EAD, she can still revert to L2 as long as you hold a valid L1.

3. I am planning to change job in case my 140 gets approved and 485 is pending > 180 days. In that case my wife definitely needs EAD thru our GC as we would loose our L status. When should I apply my spouse EAD thru GC (now or after returning from India).

*** as said earlier, you can apply before u leave for India. However, if you apply for AP, the beneficiary has to be present in US both during application and at the time of AP approval

4. What if 140/485 approves before Sep 05. How long I have to wait before I can change job. Is the 6-months period still a thumb rule? What are the consequences if I change job befor 6 months after getting my 485 approved.

*** you should consider lucky it that happens. if takes > 6 months, then u are a free bird if 140 approved, 485 pending 180+ days and new job is similar

I need some more clarification -

1. If we apply for my wife's EAD now, she would have 2 valid EADs. One thru L2 and other thru GC. Which one she can use? What are the pros cons of using either EAD?

2. If we apply for my family's (wife and son) AP, I very much doubt that we will receive it before June 24 (the day we are planning to visit India). Their going to india is very much fixed and we can not change the dates.
And if we do not apply for my family's AP now, and 485 gets approved while we are in India, is there a way they get the AP from India. What are the other ways to enter US?

3. Also, if 140 gets approved and 485 does not, can I use AC21 on L1A?

did u get any LUD on 140 . I thing you won't get one now as yours is own labour.

as I was reading all the forums i understand that every I-140 wtih EB3 substituted labour is getting LUD nearly after 1 month 25 days from receipt date. some people are getting RFE at that time and some people are getting RFE when our receipt date is current processing date. I saw some people with EB3 sub. labour I-140 has LUD and RFE regarding ability to pay after 1 month 25 days of receipt date.

so i am thinking that the RFE which u may get while processing the labour will be sent to u at that state i.e, after 1month 25 days or something.
what do u think?

hello friends,

As per the forums CSC is now working on the applications with receipt date end of december. hopefully our applications will also be touched soon. please post the updates if any body is there in january also.
