485 filed 6 months after 140 - is that concurrent?

485 filed 6 months after 140 - is that concurrent?

My I-140 was filed in October 2003 (substituted
labor) in CSC. Did not file I-485.

My question is: if I file 485 NOW, would that be
considered as "concurrent"? SHould I do that
with or without I-140 receipt number?

Also, since I would file in CSC, would it become
part of the pilot program? I hope YES

Gurus and Non-gurus, please respond.

Hi Friends,
We have another heart breaking news. The 140 online status message has been changed from "360 to 360 days" to "360 to 450" days fews days back.
Any thoughts. I think soon it will be changed to "450 to 900 days".

This really sucks, now 360 days to 450 days and few days back they said they don't want to touch concurrent I140 till I485 is ready to adjudicated, which means I485 portability option is ruined for most of us.

any update on Pilot program?

Hi All,

I got my I140 approved in 28 days.

I140 filed in first week of April. Concurrent filing.
I140 - approved in last week of April.

FP, AP, EAD -: No Info

Fo done on 05/07/2004.

AP APPROVED on 05/10/2004 for me and my wife.Today i received 2 emails from USCIS.

pilot program

All great news kabish!!

Does anyone know how long the pilot program will last?? I got my AEC letter (LC approval) last week and I sent all necessary documents for filing 140 & 485 (EB2) to the attorneys. They say it will take atleast 2-3 weeks for them to file 140 & 485 concurrently. I hope the pilot program will last this long!! I'm getting anxious here :confused:

How do you get email from USCIS? Have you registered using theier website from www.immigration.gov as a customer and
add cases to your portfolio?
Is it safe to do so?

Could you please post the details of yr case like key dates, location, work -ex, job desc, 485 filing date, any news on AP, EAD, FP, is it Eb2 case??,etc

How did you find out that it was approved. Did u check online or got a response from your attorney .

My case could be similar to yours.
140 RD -2nd April
485, EAD, AP rd - 23rd April. No news yet...

EAD / AP Approved

My I-140 RD is 7/22/03 (and it is stuck on 7/18, this is so painful :(). I did not file concurrently at that time. Finally, after about 8 months I filed the I-485 in March (3/10/2004); concurrent but a gap of 8 months between filing of 140 and 485.

Got FP letter within 2 weeks, FP done on 4/22/04. Both EAD and AP for spouse and I and AP for kid got approved within a week after 4/22/04.

Now, I don't know when my I-140 will be approved. A co-worker of mine, who filed I-140 and I-485 concurrently on 7/18/03, got his 140 approved about 2 months back.

My case details:

Category EB2
I-140: RD 7/22/03
I-485: date 3/10/04 (filed as concurrent as 140 not yet approved)
FP done: 4/22/04
EAD, AP for self, spouse, kid (AP only for kid) approved, all documents received.

Hi MRM1989,
I am same situation as yours.
Applied 140 on 8/8/03 opting for CP. Waited for four months and finally applied for 485 , seeing no movements in 140.
got EAD/AP --> 2/04
FP --> 4/04

and 140 still stuck at 7/18. Even if I only get 140, i will still opt for AC140 and go for CP instead of waiting for 485..that stupid thing will take forever...even though they start all new memo, pilot program..etc. This is all BS, try to make u " feel good " before election :)
 
Me too filed only I-140

I also filed only I-140 on 10/10/2003. EB-2 category;
Debated a lot about CP/485 and finally decided to wait for CP.
