Hello Guru's

Sorry if this is a "REPEAT" question ...

I was with company "A" on H1B... I left them and move to company "B"
Compnay "A" - Received my I-140 Approval
Comapny "A" is not insisting me to Join them ...
My H1B is good till mid 2012

what are my options ?
Do i need to join them back to go ahead with 1-485 or i can stay with Company "B" and still can become Green Card holder someday ?

or if my comapny "B" lost its path ... and say Goodbye to me ...

I am not sure what is the future ... what are the best options avaliable for me

Any anwers ... will be appraciated thanks

do you have H1 with employer B valid till 2012?
I-140 of A is approved?
when did you file I-485?
if I-140 of A is approved and I-485 is pending more than 180 days and B is ready to give you same/similar job offer letter to invoke AC21 then you can be with B and can get I-485 approved on the base of B job offer letter.

Thanks for your reply ... Sorry for not putting all info before

yes .. i have H1B with employer "B" .. I had it transfered from employer "A"

Job duties are same
- No 1-485 is not filed yes
- I-140 is approved with Employer "A"
- Can i file I-485 even with staying on employer "B" PAYROLL or do i need to go back to employer "A"
- My H1B is valid till 2012 so i guess is the job with employer "B" but u never know abt th job

------------------------you CAN file I-485 based on B I-140 approval notice. GC is for future job. you will need A job offer letter +copy of I-140 approval notice or I-140 filing reciept.

--------------------- once the I-485 pending hits 180 days you can invoke AC21 by sending B job offer letter to invoke AC21. if A revokes the approved I-140 before I-485 pending hits 180 days then you are not eligible for AC21.
Try to remain on H1 even if you file I-485.

thanks for the reply

- Company "B" has not filed anything labor or I-140
- Everything is done by Company "A" which i have left
- so i still can file I-485 with countenuing on with compnay "B" ... using offer letter and AC21 option

thanks

----------------------file the I-485 with I-140 filing reciept or with Copy of I-140 approval notice and once I-485 is pending more than 180 days you will become eligible to file AC21 request. if A revoke the I-140 BEFORE I-485 pending hits 180 days then you are not eligible for AC21. as back up let B file LC for you and remain on H1 status. if still confused go to good lawyer.
thanks
