I-140 Approved today (online status)

Can't believe it - I have checked the online status 3 or 4 times since this morning, and just now while reading this forum I decided to check once more - surprisingly the status changed and says:

Application Type: I140, IMMIGRANT PETITION FOR ALIEN WORKER

Current Status:

This case has been approved. On June 25, 2003, an approval notice was mailed. If 14 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please speak to an Immigration Information Officer during business hours.


I had got an RFE in April'03 to which BCIS had received my reply on May 9. Surprisingly EAD for me and my wife is still showing the same message and is not approved yet, as they put hold on EADs nowadays if you get an RFE.

Well, I can only say THANK GOD for now!

Can you let me know what is your RFE about in I-140 and when did you file and what kind of filing (concurrent)?

I filed concurrently on 12/27/02 and my notice date for all applications is 1/28/03.

I received an RFE asking for my employer's tax returns for the year my labor was applied, and for one of my experience letters which we think we had already sent before, but we anyway sent another copy of it.

RFE means Request for further evidence. If BCIS wants more papers or clarifications, they send you a letter asking for whatever they want. When they do this they normally put a hold on the EAD till you reply to the RFE and satisfy their requirements.

BCIS responding

It's look like BCIS is now clearing all the backlog on I-140 petitions because they are getting close to their fiscal year reports.

Few months back i have read from news letters that BCIS wanted to clear most backlogs on I-129 petitions because they are backed around 4-5 months, now that they are about a month or so in I-129 cases they are looking at I-140's

Hope they clear all these backlogs in I-140 and adjudicate them as soon as possible to provide some relief to all of us.

I saw most people posting their approvals

I am worried as RD date for my I!40 is sep 9 2003. I filed concurrently I485 too. No RFE till now god knows how they are processing. Also applied in EB3 category.

Any inputs will be appreciated ..

Hey Nipang

Did you receive your EAD yet? General observation is that if you don't get an RFE and you get your EAD, then there is nothing to worry except wait for some time.

RFE is good sometimes because after you reply to it, they see your papers first and you have chances of getting earlier approval. But on the other hand getting an RFE could be not good as maybe they want something from you which is difficult for you to get.

Even if your I-140 is approved earlier than others, I feel it doesn't quicken your I-485 approval. That I guess is another story and once again we keep waiting for it forever and in the mean time make virtual friends in this forum to give us hope.

I-140 RFE replied date :05/13/2003

I am waiting for last 1.5 months about on I-140 case (RFE for category). Online status shows that 360- days, but initial processing done and it takes less than the maximum time mentioned. But no signs of approval yet?

My EAD on hold because of I140 and RFE notice says that call BCIS in 60 days if you not heard anything, I'm waiting for 60 days to complete from my RFE responded date and want to ask attorney to send a letter about the status. BCIS customer line says that 13 months has to be passed then only they query to service center. Thats bottom line.

by the way , one question

Did they mentioned the same information on your RFE that 'call BCIS in 60 days incase if you not heard anything from them' ?

I saw you mentioned somewhere in forum , they kept hold on your EAD because of your RFE on I-140, but they didnt mention anything about my EAD in my I-140 RFE !! but service center officer told me in may that they held my EAD because of pending I-140 !!! very strange

What is your thought on this 'allthebest'

My RD date for I140 is Sep 9 2002. Your guess is true, I got EAD , AP and FP done in Nov 2002. But till today I140 is not approved . Almost 10 months for filing I140. God knows what they are doing with I140 and also no REF till now on I140.

I -140 Tracking ..

Is there a way to track our I-140 application after it has been send to the Services Center by my Lawyer ?? If so can someone give me the details or the Phone Number / email etc ..

No , I still don’t have the receipt number , How long do I have to wait before I get the number aftre applying .. Does my lawyer give m this ??

Yes you have to get copy of receipt notice which will have your EAC number.

Other way around see to copy of encashed check. Behind fees check Your EAC number will be available.
 
Thanks Tammy . I am not clear about the Check part . Since the lawyer applies on our behalf I am not sure as to how we can get the EAC number from the check ..

I guess we need to wait for the lawyer to give us the EAC number ..Am I right ??

Here is the quote from the RFE that I had received in April'03

The applicants interim benefits (I-131/I-765/I-485) have been placed on processing hold until we receive a response to our request for initial evidence on the I-140, Immigration Petition for Alien Worker.
