I 140 Approved, LUD on I485. EAD/AP to be renewed

Hi Guys,

Here are my Details

PD : 02/27/2007 ( Labor Filing date)
Concurrent filing for I 140 & I 485 : 07/26/2007 ( Notice 17th Sept 2007)
Got EAD & AP.
I 40 Approval : 08/22/2008

It's time to renew my EAD ( Expires in Sept), My Paralegal says i do not need it since i have H1 1.5 years left. Is this true that renewing EAD or AP can trigger I 485.

Moreover recently i updated mt address on 08/ 04/2008 & my I 140 was approved on 08/22/2008 but I noticed a change in LUD on mine and my wife's I 485 on 22nd aug . It's not 08/06/2008. What does this means ??? is it because of Address change or I 140 approval or something else???

What's your country of chargeability? If its EB2/EB3 India or China or EB3 ROW, your PD isnt current, so nothing can trigger I485 approval. You may or may not renew EAD, since you have time left on H-1B. Its your call.

Regarding LUD, sometimes it takes 2-3 wks (even when address is updated online) to see an LUD on I485. So that's what it could be. Its unlikely that I140 approval caused an LUD on I485 especially if your PD isnt current.

EAD and AP are an optional not a must, if you do not use them do not apply. Do not worry about LUD or better do not check them at all, these mostly internal USCIS issues triggered by known things e.g address change, transfer from dept to another....etc.

I am in EB2 India category. Wife wants to work so will have to apply hers.

They say in case i decide to change job it will be good to have EAD & AP, because i will have to move on to EAD to keep my GC on.

Any Comments?

Yes as I said if you are using or planning to use it apply. Even if you will not use it, still it is optional you can apply if you want.

No. Applying EAD/AP will not trigger anything in related to I-485.
