I-140, Ability to Pay and Small Business

I am filling out an I-140 for my company. I am concerned with showing we have an ability to pay since we are a very small business. The beneficiary/alien is currently here on a student visa so he can't work legally, but we have been paying him the amount that the prevailing wage on the Labor Cert.

I am hesitant to send tax returns because, as most companies do, we have tried to minimize our tax liability. That's great for income tax, but not too hot for the I-140 process (or getting a mortgage for that matter!).

Can anyone help or give me some suggestions?

"total income" of comapny $135k with "ordinary income" of $40k

what other numbers would help?

question ....

My company financials are

Total Income in 2004 -one mill
Total Income in 2005 -quater mill (250,000)
Total Income in 2006 - projected to be Half a million

# of Employees - 4

How good/bad shape am I in for a PERM approval?

Please advice.

another question

pursuant to the earlier msg I thought I shoot another question -

I did my Undergrad from a Canadian university in 2000 Dec. After that i was taking more classes until Jan 2002 and also worked as a Freelance s/ware developer from Canada for a firm in India.

My company want to apply GC for me and according to lawyer I could qualify for EB-2 if I show only the one year of exp from indian firm between Jan 2001 and Jan 2002. My concern is that does it matter that I was in Canada and my exp letter is from a firm in India. My nature of work was development and it was all done remotely while I was still taking classes. I was getting paid peanuts but I did for my exp.

Eric, united please advice....
