EB3 numbers unavailable in July 2005 bulletin

Guys

Check out the July 2005 visa bulletin.

It states that EB3 numbers are unavailable for the remainder of this year. The numbers would reopen in October 05. The effect this has on priority dates for EB3 is not clear. I guess if our cases get approved by the end of June, we would be very lucky. If not another endless wait

Dec filers without 140 approval?

Any December filers out there who still havent got any decision on their 140 or am i the only one ?

Our applications I-140/485 have the same RD and ND. My 140 was approved on May 19th 2005. Still waiting for 485 approvals for myself and family. The online status for my 140 has not changed. The 485 application was updated on 22nd April 2005.

Your 140 may be on the verge of approval. I hope that our 485 applications get approved by the end of June. If not we are stuck till Oct 2005 as there are no visa numbers available for EB3 for the remainder of this year.
 
Visa number are unavailable means, there wont be any 485 approvals any more? What does that mean. I applied my 485 on 05/25/2005. as per my understanding when they accept 485, they will allocate a visa number? is that true or not. Gurus please answer?.

Regarding EB3 numbers unavailable in July 2005 bulletin

I dont think that a visa number is alloted when the 485 application is accepted by the USCIS. The 485 application can only be approved if there are visa numbers available in that category.

For EB3 applicants the 485 applications cannot be adjudicated until visa numbers are available which will only be known when the numbers reopen in October 2005. The cutoff dates for these applications would only be known then

The cutoff dates can be affected by approvals of pending labor certifications by the Backlog reduction centers. There are labor certifications filed under the regular non RIR category dating back to 2000 :(

Lets hope that when the visa numbers are available in October, the cutoff dates remain untouched.
 
the NAmecheck delays have screwed up our approvals, i dont know what these ass*oles do with that :mad: dont know what PD will be like when Perm and backlog processing comes into effect
 
I have recvd following LUD on my I-485 just now. It is so confusing, what does this LUD mean ? Does anybody seen such LUD ? Does it mean RFE has been issued or case have been approved ?

"On June 13, 2005, the document we made based on the approval or registration of this case was mailed directly to the person to whom issued."

140 got approved after RFE

I got the e-mail for my 140 approval after RFE last night at 11:00pm. Special thanks to unitednations and gcfordesi04 for their valuable information. Yesterday I got the good news that my 140 got approved, meanwhile get to know that there is no visa number available for EB3 untill October.

PD: Nov. 2001, EB3/own
140/485 ND: 12/01/2004
140 RFE: RFE received on 05/10/2005
RFE response received by CIS on 06/08/2005 (140 LUD)
140 LUD on 06/10/2005 with no message change
140 LUD on 06/13/2005 message changed to approval
Waiting for 485...

My FP Done April 16 2005
My wife's FP Done May 3rd 2005
EAD:Approved in March 2005
I-140 : Approved today and got an email from USCIS website. Message changed to approval LUD also changed to 06/15/2005
I-485 : LUD Change but no message change.
My Wife's 485 : no LUD or message change.

I sent an email yesterday to CSC-XII.485@dhs.gov about myself and my wife cases I-485. I recieved just now reply from the same email that 485 cases were approved today. I checked the message again in USCIS but no change.

Hopefully LUD means approval as the email reply says!!!

Any cases like that 485 approved but no message change onlY LUD changed?

Did you have any LUD on you 140/485 before approval? My RD is same as yours and i havent heard anything from USCIS yet. I had an LUD on my 140 on 5/27 and 5/30. But nothing after that.

Also, is it possible to inquire about your 485 while your 140 is still pending?

Yes you can inquire about 485 while I140 is pending.

First Inquiry : 140 / 485 for both my wife and myself
No Response to that!

Second Inquiry : only 485 for both my wife and myself and removed I-140 WAC number.
Got a response saying these cases will be adjudicated within 4 weeks.

I got an automatic email approvals from USCIS website for I-140 on 15th. LUD Change and message also changed to approved.

Immediately after 1 hour, I got the email response for the second inquiry as well saying 485 cases approved. LUD changed for 485 but no message change.

Make sure that you put WAC number and Alien number with your /ur wife's names as applied.

Stuck in FBI name check: what to expect next?

The new dates show processing 1st march, mine was received on 28th jan, so I sent email to CSC and they notified that I am stuck in "FBI name check", anyone in the same boat? How long does this typically take :)?

I sent an e-mail yesterday requesting info about our 485's. I got quick response on the same day saying that ' name check is pending ' . But today morning i checked case status and came to know that got LUD's on both 485's with yesterday's date i.e, 06/16/05. so what do u think of LUD's. Are those because of that e-mail enquiry? Did you get any LUD's like that.
