I-140/485 Applied In December 2004

I was in a similar situation.My I140 RFE was responded to during Mid-April and I got my EAD approved in a couple of weeks from then.I would suggest you wait for a week before you go to the local INS office.
However I am still waiting for my I-140 approval.

A question on the case getting updated

Is it good to get the petition getting updated.?
I am waiting for 485 to get approved.
I485 RD: 12/23/04 ND: 01/10/05
UD: 02/08/05 Finger print update.

After 02/08/05, no update for my case.
Does that mean something when compared to cases which got updated?

wait_for_485,

From the I-485 forum posts, I hope if you don't get one LUD after FP received then your namecheck is pending!
I have the same LUD on my 485(02/08/05 Finger print update) and waiting for one more (name check) LUD.
You will get approval within 2 to 3 weeks after the namecheck LUD - no msg change.

This is my guess and could be wrong!!

LUD after FP update on 485

I dont quite agree with that.
I did get an update on 4/12/05 on my 485....this is after an update due to FP.

But u have not heard anything yet from CSC after that. In fact my I-140 LUD is still unchanged from the original date.

Just saw a LUD for all of my applications (even for approved EAD & AP) - 140,485, EAD & AP. There is no LUD for my wife's applications. Any idea why I will get a LUD on approved EAD & AP ?

1) USCIS is asking for IRS certified financial fed tax returns for 2004
2) Form DE-6 Quarterly wage report

My employer is working on getting these documents.I hope & to get this RFE responded soon

Thanks for sharing the RFE. Actually I had filed my H1 transfer and I-140/I-485 in a week difference time with my current employer . I got similar RFE ( 2 yrs of employer tax return, DE-6 wage report in a sealed envelop from EDD for last 4 quarters and city/county/state and federal buisness license of my employer) for my H1 transfer which was responded this week.

When did you get this RFE ?My company is in CA.I think we work for the same one.Did some other folks from company get some similar RFE on 140's ?

Filed my H1 transfer during last week of Nov 2004 and I140/I485 RD is Dec 15, 2004. Mine is a small company (less than 10 employees) based in CA. Rcieved RFE for H1 on 03/12/05 and responded 05/14/05. I had a LUD on I140 on 5/10/05 without any change in message.Hope it is not another RFE for I-140 ?? Lets see how this week going to be? Somebody was mentioning last week most of the I-140 had the RFE issued.

I need your feedback on my situation badly. I am in H1-B Catagory, filed I-140 & I-485 concurrently in Nov.2003 in Texas Service Center.

In Feb,2005, I received an approval notice for I-140 and few days later I was notified via USCIS e-mail notification that two notice of actions (one for me and one for my wife) were sent to my ex-lawyer's address requesting for additional information/documents on I-485 cases. Those notices were not received by my lawyer since he was going through change of addresses and at that time he mentioned that he would be unable to continue his legal service for me. Since then I made several calls to USCIS National Customer Service and couple of letters to Texas Service Center to notify the change in my Lawyer situation and to send duplicate copies of those notice of actions to my address directly but still I have not received those notice of actions, more than three months have passed, last time I talked to Customer Service Center, they told me that they updated my info.

In the mean time, another strange thing happened just to make my life more miserable, that is on April 26,2005 I received another e-mail notification stating that USCIS has mailed a notice requesting additional info/documents on my I-140 case which was approved in Feb.2005.

My questions to you:

1. What do I do now to get those notice of actions which were originally mailed on Feb.2005? Do I need a lawyer to pursue this or having a lawyer would make any difference to get those notice of actions?

2. Have you ever heard that USCIS can work or ask for additional info on an approved case( in my case it is my approved I-140)? Is this a bad sign to revoke my approval.

I would really appreciate your feedback on these matters. Thank you for your valued time and opinion.

What is substitute labor ?

Hi all,
sorry to ask you a dumb question. Is there any way from the receipts I can find if my I140/485 case is EB3 or EB2. Also what does "substitute labor mean" ? I should spend some more time learning all these, but your help will be highly appreciated.
 
Did you call emergency number to find out what the details on the RFE for 140 and 485 were? It is already nearing 90 days on your 485 RFE. You may land into issues due to non reply. I am not sure if 140 trigger is due to non reply to 485. Your best bet is probably to talk to the attorney again as even if their office moved, they would still be getting the mails.

Also try emergency again. What you are in now is a big emergency.
