I am a US citizen living in (permanent resident) Canada with my husband of 8 years and 2 children. We would like to buy a home across the border in New York and live there with my husband commuting to work across the border in Canada daily. Is filing a I-130 the best way to go to get him a permanent residence status in the US?
I am confused as to where to apply for this if it is the correct way to go, do we apply at the Consulate(Toronto) or send them to Chicago? Do we do both i-130 and i485 at the same time or wait between?

you can't file I-485, since he is not in the US.

You could file I-130 in Canada, through direct consular filing, if it is allowed in Canada.

As for Canadian-only options (such as commuter status), somebody else will add info, I am sure.
