Yes, now you file with a copy of the IJ order terminating proceedings.

did you notice the "The information submitted with the petition shows that the
person for whom you are petitioning is not eligible to file an adjustment of status application at this time."
thats the reason why i am hesitating to file my adjustment

That's why you have to show the IJ order.

Was a G-1145 (e-mail/text notification form) included with the filing? Was the check cashed?

i think my paralegal didnt include that form. the check was not cashed yet. but i am subscribed to my i-130 via text and email, you think theyre gonna notify me in that case? or i am going to have a new receipt number? btw, my wife just talked to our paralegal this afternoon, he said we need to submit the i-824, idk why, we already included the approval notice. is my case really complicated or my paralegal is not doing his job? arghhh.. tnx for the reply

You get a new number for the I-485 and each other form. The unifying # is the A#. I forget....was your I-130 shown as it would be a Consular Processed case or Adjustment case on that form??? Your case is not any more complicated or ordinary than any other case because ALL cases are individual, no two are exactly the same.

Hey, quite an interesting thread. I have my own questions....
I am about to file the I-130 under my wife's sponsorship (she is a green card holder). I am currently an F1 student and the actual visa on my passport expires in jul 2011, however, on admittance into the US, my I-94 and passport were stamped as valid for duration of status, i.e as long as I am a student, which I will still be till Dec 2011.
We have two marriage certificates; one from our native country (where we actually did the marriage ceremony in jan 2011) and another from the state of Mississippi (this was just obtained in March 2011). We hope to file this month (April 2011). My questions are:
1. Should we file the I-130 and I-485 concurrently?
2. If we file only the I-130, how long will it take before it gets approved?
a. When it does get approved, can I remain in the US even after I'm out of status (as a student)?
b. Is it true that once filed you can remain in the US even after a visa expiry or out of student status?
3. Does the approval of the I-130 make me eligible to work without requiring H1B sponsorship from an employer?
4. Which wedding certificate should we use,, the one from our native country of mississippi's?
5. What is the period of prohibition mentioned above?

heres the last NOA we received. i dont understand why they put the "not eligible for adjustment of status."

We've been through this same issue already. The IJ had jurisdiction at the time the I-130 was prepared. The IJ gave jurisdiction back to USCIS via the order you have shown. Jurisdiction is now with USCIS and an I-485 should be accepted. Showing the IJ order is the best thing to do to show USCIS that it has jurisdiction.

You actually mail the application package to a contract intake processing facility with low paid clerks who work off of limited checklists, so, make things as easy as possible to avoid getting things rejected.

You have over 80 posts but have NOT started your own thread yet on anything. It is not nice to highjack someone else's thread.

heres the last NOA we received. i dont understand why they put the "not eligible for adjustment of status."

Because at the time you were in deportation proceedings.

After July there was a memo that allowed people in deportation proceedings to adjust.

You do need your own thread.
