Okay so i am 20, and currently live in the united states, ive lived here for most of my life and even graduated high school here, however my mother never filed for me to get a greencard or anything for that matter. You may be wondering how i got here in the first place well thats a long story. I am a canadian and i was born in ontario, however my father is in jail and blah blah blah, i dont have any family in canada and i moved in with my mother in the states, ANYWAY. So i moved out of my moms house when i just turned 19 and moved in with my boyfriend, in april 29, 2010 i filed for a I 130 with my mother and step dads help (as long as i paid for it they would sign whatever i needed. I have YET to hear back anything. Now a lot of people are freaking me out telling me i should have filed for both the i 130 and the 145 i think and i didn't do that. I filed the I 130 and once that got approved i would file for the 145. Now i'm starting to get really upset because i just want to be able to go to university, and get a job, and HAVE A BANK ACCOUNT, but i cant.
I don't know what's taking so long, i don't have the money to afford a lawyer, but i am in desperate need for help.
Why is my i 130 so long i gave them more then enough papers i ever gave them my damn highschool transcript.
So i need to file the 145 now or later.
I just want my green card :(

Help please =(

It's not 145, it's the I-485 you need to file.

Was your mother a US citizen before you were born? If not, is she a US citizen now?

Did you get the I-130 receipt? It is not necessary to wait for I-130 approval. File the I-485 (and other associated papers such as the I-765, I-131, I-693 medical) with a copy of the I-130 receipt and you'll be able to get an EAD and Social Security number that will enable you to get a bank account, a job, a driver's license, and attend school.

Assuming your mother or stepdad who signed the I-130 is a US citizen, and you submitted proof of their US citizenship, the normal time frame for I-130 processing is 3-5 months. For you it's only been 4 months.

File the I-485 NOW. Even if approved, the I-130 by itself doesn't give you any legal status -- you won't be able to use the I-130 to get a job, attend school, etc.

I suggest you speak with an attorney (private or Catholic Charities if you are low income). Based on your age and your mother's long time residence and remarriage, it is possible that you are already a citizen or GC holder. I really do not think you are fully informed about your status.

How is that your green card? I am confused, was it ever issued to you? You might have to discuss your immigration status with your mother, young adults tend to be "in love", but are really crazy and rebellious..lol!!! You just happen to move-in with your boyfriend and get married, your case is going to be a nice test case for fraud.

The OP's I-130 is based on the mother's or stepdad's sponsorship, not the boyfriend or husband. If the OP gets married, that would seriously damage the prospects for a green card through the mother/stepdad.

well, we don't know the mother's immigrant status. We don't know stepdad's status. We don't even know if they got married before the OP turned 18. We don't know who filed I-130 on her behalf. So, on what basis is she supposed to file I-485?

Okay hold on. I never got married im not going to get married anytime soon. As far as my mother has told me she has never filed anything for me for immigration or visas or green cards or anything. My mom is a green card holder and has been since i was i think about 4. She married my step dad about 6 years ago and HE is the one that signed my I-130. I gave uscis so much stuff its crazy.

Birth certificate
My passport (front and back)
My mothers birth certificate
my mothers passport front and back
my mothers permanent resident card
my mothers social security card
My step dads Military ID, his Drivers lisence
Their marriage Certificate
My diploma (from south carolina)
and other stuff from my mom like her old divorce papers, and my step dads old divorce papers and stuff like that

I didnt mean to confuse anyone.

My step dad is the US citizen my mom has a greencard or whatever. My step dad was the one who signed all my stuff.. they said as long as he was married to my mom for at least 5 years then its fine.
I am only 20, im not over 21 yet, i am NOT married. I just live with my boyfriend.
My parents agreed to give me all the papers i needed but I would have to pay for everything.
I just wanted to know what exactly is my next step. I didnt know if i was to wait until after the I 130 or if i just go ahead. Again im doing this without a lawyer, so im really confused and trying to do this very efficiently.

As for how long have i been here. I have been back and forth my entire life and when i was 17 i moved the the us permanently. I went to highschool graduated, and moved out.

Sorry if i confused anyone with what i said.

I am not married, i am twenty years old and just live with my boyfriend and have been for the past year. So im filing for my status though my parents SINCE i am under 21 and unmarried.

Btw i dotn know why my mom didnt do this sooner.. that caused a huge fight ><
