I-130 lost in transit. What to do?

Hi,

I am a US citizen and I applied for my mothers
immigration. I-130 was approved but the approval
notice was lost in transit. USCIS advised me to file
I-824. I have waiting for more than six months now and
still haven't got the duplicate approval notice.

Should I still wait for the duplicate to come? Is
there a way I can file for her I-485 etc without
waiting for I-130. I have to do it quickly because she
is currently in USA. Also should we continue do it
ourselves or engage a lawyer. If yes, can you please
suggest a good lawyer in Boston.

Please advise.

Hi Ashrock:

I lost my I-130 when I filed my I-485. So I attached a copy of an approval. When I went to my interview, I printed my USCIS online copy with me.

If you don't have the I-130 copy but have the case number, may be you can print it out and attached with the I-485 application. Meanwhile, attached your copy of I-826 application to it.

USCIS hotline is very helpful. Why not call them to ask how you can get the copy back a.s.a.p.?
 
I did ask for help from USCIS. They asked me to file I-824 and get another copy of I-130. Since then I am waiting.

USCIS has many representatives. Some of them are very helpful. Some don't. Since you have already applied duplicate, call them and explain your situation. I am November 2007 filer. One of our members were so desperately needed an EAD before his H1B invalid. He called more than 3 times a day to try to speak to the right person. Finally, he got to the senior rep. who would put a service request on it.

Just a suggestion.
