I-130/I-485 questions **URGENT**

Hi I married my husband (USC, US NAVY) last October and he's currently filing I-130 for me. I have a few questions and hopefully someone can answer for me. It's very confusing for us at the moment.

1. On the immigration forms, it says we can file I-130 and I-485 concurrently. I-130 needs to be sent to Vermont Service Center and I-485 needs to be sent to Chicago. How can we file together?? Where do we send the forms to?

2. I called immigration national service center and the person I talked to told me that I should send I-130 first and wait for an approval until I can send in I-485. I mailed out I-130/2 G-325A/I-864 on 02/07/07. Do I need to wait for I-130 approval? It seems like that takes forever.

3. I am currently on OPT F-1 visa which expires on May 14, 2007. I am currently employed. There'll most likely be a gap between my OPT expiration date and my approval date. I was told to fill out the I-765 form but I couldn't find my category on the form since I am not I-485 pending (didn't send out yet). What should I do about this?

4. How long is the medical examination form valid once the doctor signed and sealed the envelop?

Anyone who can give me some suggestion would be greatly appreciated. I've heard different instructions from several sources. My husband and I are very concerned because once my OPT ends, I would lose my job.

1. Both I-130 and I-485 need to be sent together to the Chicago lockbox. Ignore what the I-130 says about sending to Vermont.

2. Ah the Misinformation hotline strikes again. That person was wrong. Did you receive a "Notice of Action" in the mail from sending your I-130 in? If so you can include that with the I-485 as proof of filing. You don't need to wait for I-130 approval before filing I-485.

3. File I-765 at the same time as I-485, in the same envelope.

4. 1 year.
 
you file the 130 and 485 together-because you are married to a USC you immediately get an alien number for your 485. when you start filling the 485 out on the 1st page it asks why you are filing-check box that says ' an immigrant petion has been filed giving me an immediate alien #'.
As far as work (765), the average wait for approval of the 765 is 75 days from the notice date of your file, but it can take up to 90 days, so you should file asap.

So I really should send out my I-485 now if I have the Notice of Action in the mail. What happens if I haven't received it yet? Do I need to include I-130 again and pay another $190?? How long does the Notice of Action usually take to arrive?

Also if I file I-765 at the same time as I-485, I would be under the category that I-485 is pending, correct?
 
If you've already filed I-130, then wait for the NOA (usually within a few weeks after you file) and then include a copy of it when you file I-485. No need to pay the I-130 fee twice.

Yes, you're under I-485 pending for I-765. Also note that on I-485 part II you should tick box "A".
 
Thank you dr_lha and catjupp for your quick replies. You have no idea how much this has helped us. I hope I found this forum earlier so I wouldn't be misled by the immigration people. :(

I should write separate checks for different forms, right? so $385 for I-485 and $180 for I-765. The package I need to send out next should include I-485/G-325a/I-693/I-864/I-765, correct?
 
Yes, separate checks are a good idea. Yes, your package should include all those things plus the Notice of Action for you I-130.

Does the NOA need to be original copy or a photo copy would work?

It's actually $395 for I-485, not $385. Also, make sure to include 2 G-325A forms, one for you, one - for your husband.

Only one is needed for the beneficiary actually. You only need one for each person if you're filing with the I-130.

That's right. I forgot... they were sent with I-130. My bad. :o

Hi Friends,

For I-130, does petitioner need to provide both copy of Naturalization cert. and US Passport copy? Or just Naturalization cert. is fine.
Petitioner has not yet applied for US passport.

Since u r currently in the U.S., u should be able to file I-485, I-130, I-765 currently to Chicago.

For ur I-765, you may choose "C(9)" under section 16.

i would like to know what this means...we have been waiting for more than two weeks now...could anyone help us!

Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Current Status: Document OTHER THAN CARD manufactured and mailed.

On February 12, 2007, we mailed the document we manufactured based on our earlier approval of this case, and mailed it to the address on we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.
 
That's only the 2nd example I've heard of that "OTHER THAN CARD" email, so who knows what it means. Do tell us when your "OTHER THAN CARD" arrives. Still it says "approval", which can only be a good thing.
 
I am in the same situation. I made the mistake by not filing 485 togetehr with 130 for my mom. Now 130 has been approved (after 2.5 month). I am gonna file 485. Does anyone know if this separately filling will take much longer now
