I-130 filed for Mother and father Dec 15th no approval yet

Hi everyone. I keep checking the USCIS website and it says processing time for I 130 for mother and father is 5 months. I filed I -130 notice date Dec 15th 2009, and is 3 months already and their status is under initial review. Is the whole process 5 months in US or the whole process with consular proceeding in US ambassy in Macedonia? How long will be for their approval? Also, my father overstayed with expired visa in US from 1994 to January 31st 2001. Is it posable to deny him under I-130??

5 months for the I-130 approval, before it gets forwarded on to NVC.

Also, my father overstayed with expired visa in US from 1994 to January 31st 2001. Is it posable to deny him under I-130??

The I-130 will be approved, but he is subject to the 10-year re-entry bar until February 1st, 2011.
 
So he will be approved, but visa will not be issued to him until 2011?? Then my mom should be under in the same boat. She has never been to US, but when she applied for visa in 2001, she provided false information to the consul and they said verbally to her, that she will never be able to enter US. Do you think they might deny her for this??

Yes. Your mom is barred from entering the US for life.
 
Can they do that??I mean can they deny my mother from entry in US for life? Im US citizen, and one of the rights to be US citizen is to vote, and the other is that you can bring your parents to US. I can have a lawsuit if they do that...
 
I submitted I-30s for both of my parents in November2009 and my mom's was finally approved on 02/24/10 but my dad's has not. It is still showing under initial review, so I wouldn't worry about it just yet.
 
Status is still initial review

I filed the I-130 on November 26, 2009, received receipt that it was received on December 3, 2009. And the status is still initial review. I am a U.S. citizen that petitioned for my spouse to come to the US. Any idea how long for a approval before he can finally come to the U.S.? He wants to go back to college and wants to start in the summer which would be June 1st.

While you have a right to sponsor your parents, your parents have no right to enter the US. Your mothermade a false statement to get an immigration benefit, and the INA clearly states that there is a non-waiverable, lifetime bar for this.

Rights can be lost if the law is violated. For example, commit a felony, and you won't be allowed to own a gun or vote (although some states will restore your right to vote after some number of years).

You should hope your father's application is delayed until next year, because if he shows up at the consulate before the 10-year ban expires, they can deny him for that. They probably have the option to reschedule the interview for a date after the 10 years are finished, but I don't know that they're obligated to reschedule instead of denying outright, so it's best for him not to be interviewed before the 10 years are done.
