I-130 Approved - Need advice on a very complicated case!

Hi,

I am a Cyprus Citizen married to a US Citizen and I need some advice please. I started the Green Card application while working in Alaska under H1-B a few months ago and here's what happened:

On May 19th, CIS received the following:

- I-485 (APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS)
- I-130 (IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN)
- I-765 (APPLICATION FOR EMPLOYMENT AUTHORIZATION)
- I-131 (APPLICATION FOR USCIS TRAVEL DOCUMENT)

On September 1st, I resigned from the company I was working for in Alaska (because we decided to move to Seattle) and we drove through Canada to go to Seattle. On September 6th, I attempted crossing the US Border (about 2 hours away from Seattle) and I was denied entrance. The reason was that I didn't have a travel document (I-131 - it is still pending). I was also told that since I resigned my job in Alaksa my work visa (H1-B) became invalid. I even tried to use my valid tourist visa (B1/B2) but that was not accepted since I wasn't a tourist. Since I was denied entrance, I decided to come back to Cyprus.

On September 16th, I received an email from CIS saying "Your I-765 application was denied on 09/15/2008. You will receive a denial letter explaining the decision shortly" (I haven't received the letter yet).

Yesterday, I was notified that my I-130 application was approved and I got the approval notice.

I-485 and I-131 are still pending.

What should I do now? Can I continue the Green Card process in the US Consulate in Cyprus? Can you help me?

My take on this is if you leave the country like you did( alaska to canada) AOS pending before you recieve i-131. Your i-485 is considered abandoned. I think you will have to go the consular route now that your AOS is abandoned.
