I-130 Approved, Lawyer unresponsive, Next Steps?

Hello,

It's been a winded path so far and was hoping to reach out to the community for some advice. Here's a basic summary of where I am with the petitions/status:

- Relative applied with I-130 for myself several years back through a lawyer in California
- The I-130 was approved
- I am currently residing overseas at this time and the lawyer who was handling my case has been unresponsive (not returning calls, emails etc.).

Given the above, I am unsure as to how to proceed. I realize that I need to file the I-485 (and eventually onward to the interview) but given that I can't get through to the lawyer, I don't know how to move forward.

Can anyone recommend what my next steps should be to deal with this mess up? :(

whether you can apply for an immigrant visa also depends on what kind of relative applied for you and whether your priority date is current. You don't need a lawyer to proceed with your case anyway.

Thanks for your message. The relative that had filed for the petition was my father. Also, the priority date is from back in 1999.

Is this case a goner?

Thanks for the heads up on that end. If not the I-485 (did some further research on it and you were certainly right on your point). If not the I-485 though, what is it that I'm supposed to file? Am I supposed to have my case transfered to the local embassy?

is your father a US citizen? are you married?


if your father is a USC and you are unmarried, the case has been current for a couple of years. Your father should call USCIS about the petition, better - call NVC (National Visa Center). A notice from NVC may have been sent to your father and the lawyer (you should have been copied on it too).

If your father is an LPR and you are unmarried, then your PD is not current yet.

If your father is an LPR and you are married, your application is null.
