I-130 Application Approvals and Priority Date (which is more important)

Hi Everyone,

An I-130 application has been filed on behalf of me a couple of years ago (my wife is a GC holder) and it seems that my immigrant visa number is going to be available. However, my I-130 has not yet been processed. So the question is if a visa number becomes available for me but my I-130 application is not yet processed, what can I do?

I am already in US on an F1 visa and studying. Is it possible to file for I485 (adjustment of status) before I-130 is approved (since I am already in US)? Or is it possile to get a work permit?

Any advice would be appreciated

You should wait for the approval letter

The I-130 is the petition filed for you buy a alien relatif , it must be approved at first before you can file an I-485 because your relative is a GC holder . Even if a visas number is available to your filling date periode , you should wait for the aproval notice which give you the right to apply to file an adjustment of status application when a visa number is available to you . It is one of the requierement of filing for I-485 that you send a copy of the approval notice or your case will be denied and your lost your money and your time .

When the visa number is available to my filing date period, Do I get notification from INS or any approval/letter/email?

right now the wait for a visa number for spouses of green card holders is about 5-6 years. Check out the current visa bulletin at www.travel.state.gov

The new rule of adjudicating I-130 says that it will now be adjudicated closer to the date when the number is available. But even if I-130 is approved right away, you still can't apply for adjustment of status, until the visa number is available to you. Whether you get notified - I don't know.
 
how long till the interview when the visa number is available and filed i-485 ?

Hello , i just wanted to know how long it would take for the ASO(adjustment of status) interview after a visa number has been available to me and that i filed the i-485 based on a mariage petition that has been filed on my behalf since april 2001 and that the priority date is in april ? would i wait some years again before this interview or would it be iin a matter of months ?

the time it takes USCIS to adjudicate your I-485 depends on your local district. Check out processing times on www.uscis.gov for your particular district, for I-485 form.
 
I-130

my file was submited on aug 1999 marride daughter of USC. i have recwived the approal letter. i want to know time period to reach US ?
