I-129 assistance - petition receipt and prior petition

Hi,

I am about the apply for an extension using the I-129, and have done this before. My question (I honestly looked and couldn't find the answer) is this:

1) Part 2 question 3-petition recipt number - is this ALWAYS your I-94 number, or is is the EAC number? If the last renewal was by mail, should I make any indication about the PFI (I assume you would only state this if your last TN was at a PFI, but I am confused looking at my own docs...)
2) Question 4 prior petition - Is this ALWAYS your I-94 number or should it be the EAC number?

Petition is the I-129 number not the I-94. I-94 is not a petition.

If one has never sent an I-129, they leave this field blank. They still don't put the I-94 number.

So that would be the EAC xx-xxx-xxxxx from the form.

One more note - in other threads people have stated this should be the I-94 number. So we have been incorrect previously in this understanding?

Yes, the people saying that a 'petition' # can be satisfied by putting an I-94 number are wrong, and always have been.

Some petitions (like I-539, I-765) ask for one's I-94 #. On these feel free to supply the I-94 #. in fact, i-129 in another section asks for I-94 #.

See the difference?

I have a very similar question, and I've been looking all over the place for an answer and calling the USCIS Customer Service to no avail.

I currently have an F-1 visa, working under OPT (I have an Employment Authorization Card). My employer is going to file Form I-129 but we're having trouble figuring out Part 2, Question 4: "Prior Petition." What would be the prior petition or application receipt #? (Note: In Question 5 ("Requested Action") we are choosing option b) "Change the person's status and extend their stay since the person(s) are all now in the U.S. in another status.")
 
Was a prior petition ever filed for you. If not, and swer N/A.
(b) is correct. Including a copy of your current I-94 will indicate this

Not an I-129 petition... but I've filed other stuff to get my F-1 visa years ago and also recently to get my Employment Authorization Card (with an Alien #).

Is it still N/A?

If you filed a petition to get the status you are currently in (that is the question after all), what was it case number? If you got this status at the border, write N/A.

I filed a I-765 form to get an Employment Authorization Card about a year ago (and I got a new F-1 visa for one year). So should I put in the case number for that form (I-765) in the Prior Petition question in my I-129 ?

(this is for H-1B not TN, though I don't think it should matter for this particular issue)

EAD is not your STATUS, your STATUS is F1. If you got your F1 with a petition (hint: it would be an I-539).....
