I-129 and international travels

Hey guys,

I am currently working in the US with a TN visa. I will be changing employer and the lawyer recommended filing I-129 with USCIS. My question is that can I go to Canana/Mexico while I-129 is been filed, or shall I postpone my travels until I receive my approval?

If you are Cdn, it doesn't matter. I-129s are NOT considered abandoned if you leave (some say they are cancelled but there is much evidence that they are not), so you will get approved even if out of country. even if denied, when you enter simply get the TN at the entry point, like most Cdns do.

A CHANGE in status (your situation is not a change) would require waiting, if you wish the I-129 to be approved. Your is simply a request for another TN,

Thanks Nelsona, my current employer is also filing a H1B (I-129) for me at the same time (i just got the lottery this year), will this impact my TN I-129?
 
Well, your H1 won't be effective until October. So you will need a TN first, and then the H1-B will kick in Oct 1, 2022. Neither is affected by travel, since these are the employer's petitions.
