HVI+ and applying for GC

Hi guys; I am going to talk about something that may still be TABOO; I haven’t read such case here yet. I am leaving in US for the past 6 years and I was granted asylum 2 yeas ago (granted by the immigration officer, did not need to go to court) , I hired a very good lawyer who call me “ the miracle case “ because : 1- my country of citizenship have a very large amount of immigrants but the applications for asylum is inexistence well almost. 2- I applied off time, meaning after the 1 year and 1 day after my arrival and 3- I was diagnosed HIV+ while leaving in here. The time haves arrived for me to apply for adjustment for a permanent status and I done so; my lawyer said is going to be ok because we sent all the paper work they required including a waiver for my health condition and God knows I trust her. Bottom on line I don’t know anybody who is in my same situation and no even a friend of a friend, I am very confident that all will be fine but would be nice is somebody could share any experience or knowledge about this topic.

Hi Angel,

This subject is not taboo at all. In fact, the US Senate just yesterday (July 16th) passed PEPFAR, which lifts the ban on HIV+ immigrants as well as travelers to the US. It is expected to be signed by "the president" soon. If you are an asylee, you are eligible for the waiver anyway so I don't think you have anything to worry about. But just to rest easier, and if your lawyer says its okay, you may want to wait till the ban is completely lifted (When Bush signs it and it is in effect). I know there is someone on this forum who has gone through this process before regarding the HIV waiver. You can do a search for him/her...

Thanks a lot guys for the public replies and the those who choose to do it in private. A lot of support in this forum and I really appreciate it. My paper work was sent to immigration already I’m just playing to everything goes well and I have faith the hiv ban will be avoid.

i work everyday with people from differents countries who are refugees or asyleess//DON'T WORRY...you just send your aplication for green card with the waiver that your lawyer gonna get for you and that';s it
EVERYTHING IS GONNA be ok...i have a friend who work with me ..he's from africa..asylee and he's got your same illness...now hes permanent resident..not problem at all

Thanks guys , yep the sky seems clear , I did some research and I found that PEPFAR ( the legislation to void the HIV ban in USA already passed by the congress ) will very likely sign by the president and become a law. ( smile) . I am very optimistic.
 
you should definitely be optimistic! even without the new law, you are set because your HIV status was part of the base for your asylum.
 
If you are HIV+, and you were granted asylum, you will have no problems getting your green card. Asylees qualify for the HIV waiver, so, as long as you send your waiver with your I-485 application, your GC will be on the mail soon.
Now, if you are NOT an asylee and you are HIV+, it is a different story. Waivers are not usually granted for any immigrant other than asylees and refugees.

CIS may ask you to register with CDC and get a recommendation from them, but that its easy. I have a close relative who went trough the same exact process and now he is getting ready to apply for his citizenship.
I have seen these cases at work all the time, dont worry at all Angel.
