When hope almost ends then something happens.

It was 12:00 AM and just before going to bed I just went by habit to check my LUD and guess what :

MY 140 HAS BEEN APPROVED.

After a long dreadful wait I am onward bound. All the best to everyone esp. ones with an RFE and one's whose no update has happened for a long time. You will come thru.

Congratulations yeppo.

After reading your mail, I checked my LUD again. Well no change. It is still sitting at 7/28.

Never the less, your approval after no activity for 6 weeks gives hope.

Enjoy life. And sleep well...If you can after this excitement.

Or else, go out and have a chilled icecream with your loved ones. After all, it is worth enjoying differently.

140/485 ND : 09/25/2003
First EAD approved : 11/19/2003, 2nd EAD 08/19/2004
First FP 09/11/2004. Website change and mail on 09/16/2004 to reflect FP rcpt
Spouse FP 09/25/2004

140 history:
RFE on Education 06/16/2004. Email and website change
Responded on 08/12/2004 with Education Re-eval by Trustforte. Email website change
LUD changes on 08/13, 08/16, 08/17 no message, no email
140 AD : 09/28/2004

I got it too yester day with strange message

Not sure what it means. I got RFE for I-140 and asked for 2001 financial statements of company and w2 of mine. my case is not denial and re-opened case. only 3 guys got this month in whole this discussionboard. no other info from anyone.

here is the message:
On September 27, 2004, we mailed you a notice that we certified our approval of this case and sent it to the appellate body for review. The notice explains in detail the basis for this proposed action. If 14 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please call the National Customer Service Center at (800) 375-5283.

Please advise...
 
Congratulations Yeppo.Your Case approval is sure going to give Hopes to alot of People.I Checked my cas and there is an LUD change with the status message remaining the same.

The 485 LUD did not change with the 140. It changed recently to reflect the FP rcvd. I am just hoping that the 485 gets done at this pace. If so i will definitely buy a lottery ticket.

Yes I know that there are a lot of cases similar to mine. I personally would say that the attorney matters a lot. My attorney took nearly 2 months to respond. Kept saying he wanted to make the legal brief very strong and I used to crib. But I guess it was worth the wait.

Do it once and get it right.

I am pissed by USCIS no approval. on I-140.. yet....

Congrats on your I-140 approval. Hope your 485 also comes through soon. Can you share your RFE details?? Had you submitted a Edn Eval from Trustforte itself during your I-140 filing?? What was the re-eval about?? Would help other applicants who might encounter a similar RFE.
 
My RFE details were as follows:

I was incorrectly filed under EB2 as I have 3yr degree + 1.5 yr diploma. An edu eval from some vague Educational testing services was attached (same one done for h1) at time of filing.

The RFE asked additional evidence to prove that the ETA education requirement was met.

My lawyer (from what I can gather) asked for a reclassification from Eb2 to Eb3 with a new evaluation attached from Trustforte. Of course I have no idea how he prepared the actual reply (they wont reveal their trade secrets)but this what I gathered from him.

I hope this helps.

I have I140 RFE receipt date of Sep 13, 2004;
I was getting jittery why am I not getting any change yet.
Yeppo's case gives me respite.

Is any one having I140 RFE reply date similar to mine and have got an update?

My RFE was for clear copies of degree certi's, education re-evaluation and experience letter.
