That's what I was told by the agent when he called me into his office. He said, you are facing removal and deportation because you are not a citizen. You were close but your file was never completed, it is missing some pages. That's what he told me. Yes. I don't think there was an issue. I think I was screwed over by an incompetent INS agentIf the form was submitted in the 1990s I’m not clear on why it was never followed up on at that stage. If you were under 14 when it was done as you said above it would have been submitted before 1993. It seems really odd that it was just left until 2002 to be told there was an issue.
But I still don’t understand. Your father filed an N400 for you, never got notice of naturalization and just…left it? Are you sure there was no RFE sent at the time? I have no idea. We are trying to dig through everything right now. The n400 form is 16 pages. The n400 form on the CD is the entire 16 pages complete. I do not know what the laws were back then. Highly doubtful that is what happened. Possibly a RFE was sent regarding the missing pages. Seemed more to me like your father dropped the ball. Yeah but just filing it doesn’t actually mean anything if there was an issue like a RFE and the case was never processed to conclusion. If what the FOIA sent is your A-file, if the case was processed to conclusion so that a certificate of naturalization or citizenship exists, it would be in there. There is no rfe in FOIA, 90% of the things on the disk are legal forms from INS attempting to deport me and blank pages . I did an FOIA today with USCIS asking for everything they have from my adoption specifically any forms like N600 or N400 or any forms having to do with citizenship.Again the pages were not missing. C files were not used after 1956. We didn't receive anything about my A file. If you became a citizen then you would also have a C-file.
The pages on the form may have been there, but do you have copies of the supporting evidence that was supplied and do you have any way to confirm that everything your father needed to submit to support your application (ie green card and various supporting documents) was provided?Again the pages were not missing.
