How to make case inquiry to Miami local office

My case was transferred to Miami this July. And I confirmed the document
is at Miami local office during a Infopass appointment 2 weeks ago.

Now the Miami 485 processing time is April 2003 while my RD is March 2002,
so I think I can make case inquiry now. What kind of process do I need to follow?

I thought about the following possiblities:
1. call that 800 national service number and make inquiry?
2. ask my lawyer to make inquiry
3. send a letter to make inquiry. But I don't know where should I send
this letter, TSC or Miami. What address should I use?
4. ask a congressman or senator?

Anybody have any idea?
 
I called the 1-800 number, all they can do is send an inquiry for the status.

Personnally, I would go to the Miami office in person and inquire, and also call the 1-800 number to have a track record of your inquiry.

I don't think going to Maimi office will help with case inquiry. In fact, I did
a infopass interview at Miami 2 weeks ago. I noticed now all the infopass
interview is conducted in a separate building several blocks away from that
shitty brown colored tall building (which does the actual case processing). This building used to be office for a state park. All it has inside now is just
several stupid officers and a computer which can be used to browse internet.

During the interview, I told the officer my case was applied one year earlier
than the current official processing time of Miami office. But she just doesn't want (or she doesn't even know how) to make a inquiry to those officers in
a building serveral blocks away. She only told me shit that "every case is different and you case will be processed when it will be processed"...

I asked them is that true "your office can not even keep the word you published on your official website" and she said "yes and no because that
published time is just a rough statistics information".

So I told her that I drove all the way here, giving up a vacation day to hear this useless information. why can't I just make a phone call, and she said
"this is our policy that all information can be get by infopass interview". I told her this is "a total bull shit" and left.

I already called 800 number today and did a case inquiry, and my lawyer
promised me to send a mail to Miami regarding the delay.

Have you ever tried to use congress man or senator? Do you think if it will work or not.

According to the Rajjiv's Transcript of 9-24 Hearing, it seems 90% of the
I485 case are processed in service center, leaving only 10% transferred. Why
the hell are we the unlucky one to get transferred?

seems w-man got tough time there, many shared story diff then written here,


First never ask directly about inquirey, After Hi/hello make atmosphere in ur favoour with some praise/humor, convience them somehow, ask politely not direct inquery, say in this way, you are here to get confirmation that case were transfered and you got all my papers. and appreciate it if they can help you out in it, thats it STOP........

they would let u know about confirmation plus status and time estimated, and would issue letter or let u know when u expect.

If u can aford attorney let him/her be with u.

If one is charismatic or not as per POJ's suggestion, almost nothing will make these Miami officers do their work at all. They would rather sit there and act dumb.

Actually I just handed her my case status printout and she told me my interview won't be for a few more months. I hadn't even asked any questions at that point yet, and I told her that that is not what I came to ask. Read the next paragraph, you need to figure out a way to waste thier time, in a polite yet tenacious manner.

I think I may have hit on something last time I was there. They are so lazy that they just want to go home at the end of the day. Book your appointment for the last time slot of the day, and politely but consistently and slowly and very calmly speak to them to ask about your case. Try to waste as much of their time as you possibly can. They are limited in the amount time they have to get rid of you. Use this fact to your advantage against them. Keep asking the same questions in circles pretending that the last answer was not acceptable, and you require a better answer and additional information. They will get worn down by your patience, since at the end of they day, they have no patience, and no strength left either. They are human just like you, but you took the whole day off from work to come here, while they've been standing there all day just waiting to go home and watch TV. Your advantage is that you are stronger than them at this point, and there is no need for you to get excited or upset. You already took the entire day off and you're in no rush to get into the rush hour traffic, You can stand there and discuss your problems all day if you had too, since you have the strength and time to burn, They don't. Eventually they will give up because they just want to go home and get rid of you. Its all psychological. They just want to go home. Their simple minds want to leave the confines of this dead end job.

Wolfman is right. These people are hard to crack. Sharing your experience has given me a bit of forewarning, but I'm not sure even I will get through their thick skulls. I will try some more brain tricks on them this time, its fun to see them get tangled in their own words.

I haven't used a congressman nor a senator. I believe they are as powerless as us. I believe our strongest weapon is to request a Freedom of Information Act. This will force them to at least pull my case off of the shelf. But my personal view is that although I am fed up with waiting, there are others in this forum that are worse off then both of us. We do not merit using these extreme measures yet, even though we are past the official processing dates for both Miami and Texas.

In a war the winners are those who are resilient and wise, waiting for the right moment to strike, not the desperate ones that run into battle screaming and firing all their guns at the onset.

I was planning to visit the Miami office every 30 days until I get adjudicated. Your statement has encouraged me even more to proceed with this plan:

Fine.

If that is a true and honest statement, then they will be seeing a lot of me, that is for sure now, since they have admitted that there is no other way for me to communicate with them about my case, except to show up at their office and bother them and waste more of thier boring time. If that's what they want, then that's what they'll get. I will wear them down like a pencil in a pencil sharpener. If we on this forum waiting for an interview, swamped the Miami office every 30 days, they would eventually get the message.

Don't give up. Let the rejection you got from that officer give you even more strength.

I hope I've given you some hope for the next time you go see them.

By the way, you have reminded me of that "George" in "Seinfeld". I like
your style, really.

I am living in Naples, which is about 2 hours from Miami. I guess we
may have before in Miami, who knows.

I believe most of us can understand this phrase "Ghee therhee unglee say hee niklata hay". all I meant that there is two way to get info whatever you looking for, one is go with your attorney (if afordable) second facial exprestions/attitude/ and chossn words make difference, just read what happened. this is not critise or anything... fact is they want u to be angry....... upset... all blah blah........ its upto you how u deal.

I always try learn from my and others ppl experience.... and never try to re-invent the wheel. :D . if you feel u are angry , short temper, best thing go with attorney let them deal. or you need some technique/tricks to get info what u need from them. not using that style. :D . I applogize to w-man if he minds , this is not criticise just friend's adivse. keep smile on face :D.
btw a have u think that why attorney get good response and not individual?.
plus filing G-28 also mean that representative of ur case is ur attorney not applicant. so all I learned is when u have to deal go through proper chanel not jump urself and hurt/messup ur petition. for ur knowledge at interview even u qualify by document they may refuse just becz attitude or other reason.

want to say and I know you want to give me a advice from a true friend.

I am only angry against those bastards in CIS, but I am truly a everyone's
buddy in this forum.

It is very difficult for me to put on a smiling faces to those rats in CIS. I just
think they are bunch of lower form creatures with a brian no bigger than a peanut. I felt humiliated for just talking with them.

I just don't understand why we have to make trick to get correct and useful
information from a CIS officer. Aren't they the same as those guys working in
city hall, driver license office or police office?

I agree that showing your anger will not get you far. This is definitely true. And I also agree with your statement that they just want us to get angry. Unfortunatley for them, anger does not show in my expressions easily to others who do not know me well, so it takes a lot to tick me off, and go balistic.

Basically we both agree that when you go see them you need to stay calm, and this is exactly the method that will get them more tired of you, and eventually eant to help you just to make you finnally leave.

I'm not angy with you at all. I am totally angry with this comletely disorganized process we call USCIS.
 
Miami to WPB

My case was transfer to Miami office, FL in June 2004 from TSC. It was supposed to be transferred to West Palm Beach Office, FL instead. I am not sure how long will it take to do the intermediate transfers between the two offices. How do I know where is my case now?

As you are saying "Transfered to Miami" I am asuming you learned from online status. is it? or you received written notice ?

Your questoin is how to find where ur case is? in my opinion it would be in the office where it says "Transfered to" (Miami), . and how to confirm it>>>>>> ummmm that is realy ppl are getting difficulty but some got sucess to know exact status.

Try this.

Use Your attorney (whatever ur Att hesitate or giving u story 'don't worry blah blah' ... just put some $$ :D on his table even before u speak and see magic). tell him why u are here and say "I like YOU(att) to do me some favour and I am glad to pay any extra effort u make and I like You(att) like to do".

1. Create a letter send to Miami Office (Post +Fax ),
2. Call them and and make confirmaiton.
3. Use Infopass apoointment try to go with ur attorney(again $$ works fine :D )

if u dont' hear anything keep using ur attorney keep continue that efforts. most of ppl who I shared with using attorney either expressed concern about non-coop attorney, I believe here everyting is for sale what would u like to buy?. it cost but peace in mind.

the best option is to make an infopass appointment at Miami. Ask them if they got the case yet, and also ask if they know whether it will be transferrd to West Palm or not, and if so, when. Chances are they won't give you an aswer either way. No need to spend money to bring a lawyer just for a status update. The lawyer won't be able to do much.

I visited the "new" Miami office. Here is a summary of my experience, hopefully this helps you, or someone else on this board:

The first lady I met could hardly understand English. I have no accent, and I still had to repeat my questions 5 times. I wondered how she would communicate with someone who is not of Hispanic descent, and who speaks English with a foreign accent. I am betting those people would not get good service from this lady. I took her name down. I'm not going to publish it here, but I just took it for future reference when I go back in a month. I asked her all kinds of questions:

1) How are you?
A: {No answer}

2) was hoping you could help with my case.
A: {I handed her the printout of my status from the USCIS website} Do you have your I-485 receipt? {I handed her a photocopy of my receipt.}

3) Can you verify my address on file?
A: NO, I cannot do that. Did you move recently?

4) Yes I moved about 2 years ago. I want to verify that you have my correct address.
A: This is the address I have in your file.(repeated my correct address)
comment in my head: Why the hell did she tell me she can't check my address, and then she checked it?

5) Can you verify that you got my fingerprints?
A: Sir, we do not do fingerprints in this office. You will get a notice in the mail to go get your fingerprints.

6) No. That is not what I asked. I want to know if your system shows whether or not you got my fingerprints form the FBI.
A: The FBI does the fingerprints not us.

7) No. That is not what I asked. I did my fingerprints. I want to know if the were successfully transferred to you.
A: Let me check....It shows that you did your fingerprints in August 2003.

8) What is the status of my fingerprints?
A: We don't check the status. That's the officer that works on your case. Not us.

9) So you can't tell me if my fingerprints are ok or not?
A: No. that is not us.

10) What about the name check?
A: {nodding her head "NO"}

11) How long are fingerprints valid for?
A: 15 months?

12) When will mine expire?
A: November 2004.

13) That is next month. Will I get an interview for my case before my fingerprints expire?
A: Sir, that is up to the officer who is working on your case.

14) I need to apply for my 4th EAD and my 4th Advance parole. Should I apply, or will I have an interview soon?
A: We do not take EAD applications at this office anymore, you need to send that by mail.

15) No that's not what I asked. If I need to apply for my 4th EAD, and redo my fingerprints, I will need to pay another $365 just to keep this case going, and this is ridiculous, since my case should have been approved long ago.
A: do you have the receipt for your EAD?

16) No I did not apply for it yet. Should I apply I, or should I wait?
A: We don't take EAD applications here anymore.

17) Is there an officer currently working on my case?
A: No. It is still waiting to be process, and you do not have an interview date scheduled yet.

18) Can I request an interview?
A: You can request an interview by sending a letter in the mail.
comment in my head: Why the hell would I need to send a letter if I'm already here in person.

19) What is the current processing date in Miami?
A: This is an employment based case. The processing dates are not for employment based cases, because Miami does not usually process these types of I-485 cases.

20) OK. But you have my case now, and you just told me its waiting to be processed. So what is the processing date for cases like mine? I am sure you have other employment based cases that got transferred from the service centers.
A: {Again nodding her head NO}

21) What, you have no other employment based cases? Are you telling me that because my case got transferred here, its in a black hole, and you don't know what the status is?
A: Its not in a black hole.

22) You must need to report your statistics somehow to the Deportment of homeland security on the progress of the cases that you have here. How can you report how much time is left to process the employment based cases that you have, if you are telling me that you have no clue.
A:{Still nodding her head. I can tell she does not understand what I am saying, and she seems frustrated} You need to talk to a supervisor, I cannot keep repeating the same answer over again. {writes my name on a post it note, and tells me to wait}

I waited for about 10 minutes, and the lady in the next cubicle called my name. Again, same problem, she barely understood English. I got her name also for future reference also.

1) Hi. How are you?
A: Fine and you?

2) Fine. I was wondering if you could help me with my case. Here is my I-485 receipt.
A: These computers are so slow today......

3) Your computer needs some coffee! (smiling)
A: No, I'm the one that needs coffee (also smiling, I'm off to a good start) What is the problem?

4) My case was transferred here from the Texas Service Center. I've been waiting for an interview, and my EAD, Advance Parole and fingerprints are expiring......
A: (she interrupts me) We don't process EAD applications here. You need to send that by mail.

5) I know that. I have already had 3 EADs and 3 Advance paroles. If I need to apply for a forth one, that is $175 for the EAD, $165 for the Advance Parole, and $25 for the fingerprints. I've had these already 3 times. Why should I need to apply for them a 4th time, just because the case is still pending?
A: There are millions of cases waiting to be processed.

6) What is the current process date for cases like mine?
A: We don't have the processing date for your case because its an Employment based case, and we deal with different kinds of I-485 cases.

7) You just told me there are millions of cases like mine. How is it that you don't know the status of al these cases?
A: There are very few employment based transfer cases here in Miami. So we don't track the current processing date for employment based cases.

8) So how long do I have to wait? Months? Years? Until I die? please tell me. This is silly for you not to know such simple thing. When you go apply for a passport, they can tell you exactly how long to wait. Why can't you?
A: I'm sorry I can't help you. You'll just have to wait. They will send you a notice in the mail. Is your address {starts reading out my OLD address]

9) No. no. That's my old address. Here is my new one. {Gave here my driver's license), she could barely read it, so I had to read it to her anyways) (Note that the first lady had the correct address in the system, the second one did not. What a horror.)

10) Can you read it back to me?
A: {She read it back correctly}

11) OK, so if you can't give me a processing date, can you request an interview for me?
A: Of course I can. {note that the first lady required that I send a letter to request this} {she went to get a form for me to fill out} fill out this form with the all reasons you gave me.

The form only has 2 small lines for remarks. Barely enough to write all my reasons. I remember reading in the I-485 Standard Operating Procedure that PrinceOfJungle provided that one of the ways to expedite a case is to show an economic hardship. So, I filled out the form, and said that I am requesting an interview due to economic hardship because I need to pay $365 for the 4th time just to keep this case going. I require an interview in October to avoid paying these fees a 4th time.

She made me a copy, and she said she will fax it to the other building on 79th street. She said they will notify me.

I was there a total of about 30 minutes. I'll be back next month.
