how to get IEAD if 90 days have not passed

My EAD is expiring in a few days and last ead was filed on 1/18 ( vsc dates show 1/22) .My 485 pd is 9/20 ( vsc showes 1/29/2004).

How to get IEAD ?

I am also on the same boat. Myn is expiring pretty soon and applied for the renewal on Feb 28th 2005. How to get the I-EAD to work or else I will be without job.
 
Go to Local USCIS Office

If more than 3 months have passed then you can get a temp. EAD issued by going to local USCIS District office. You end up spending an entire day like I did at Newark office.
 
For that you need to take an Infopass appointment to goto the nearest USCIS center.

Idea is get help to get IEAD if 90 days have not passed.
I know the procedure if 90 days have passed.
 
take a chance

Take a chance . Show that your date is before current processing published dates.

Also place a call on the 800 number and try to speak. I am sure you may get pretty soon. Any LUD changes on these.

I got my 485 approvel this morning.
Local office did not entetain req for iead.
I had called VSC last week and explained the situation.
Looks like they helped.
Is there a number /emai id to send thanks to VSC?

My suggestion is to drop the idea, as this will be probably the first time someone has thanked them. They might get suspicious and repoen your 485!

I know ppl have successfully done this by showing a letter from employer saying they will be laid off if they do not have valid work authorization.

So try your luck and use the above to get iEAD before 90 days of filing.
 
sertra2002: Can you explain me in detail about the letter to show immigration officer about laying off if EAD is not there. Myn is expiring pretty pretty soon. I need badly EAD or else laid off. Is this process worked with any one !!! I took an appointment with local INS office by using infopass. If you could provide me more information about what to explain to immigration officer to get I-EAD.

less99: First of all Congratulations on your 485 approval. Can you explain me the process how did you get approached INS and what triggered your 485 approval. My 485 ND is 09/2003 and now they are processing 01/2004. My EAD is expiring next week and I applied just a month back. If I won't get I-EAD then I have to live without job. Please share your experience with me.

I too called VSC recently and told them that my EAD is expiring and I don't have a new one and also my I485 is pending from Dec 2002, but the rep told me not to call VSC for EAD and asked me to call the 1800 Number.

Please let the forum know that actually did you say to the rep at VSC and I will try using the same.

I couldn't get you. You said you called VSC(should be 1 800 number) then why he asked you call again 1 800 !!! is there is any two different 1-800 numbers !!!

The letter should simply state that 'Your Name' is employed as 'Your Designation' in 'Your Commpany, since 'Join date'. It should also go on to say that the employment is based on the fact that 'your name' will have legal work authorization. The company cannot employ you if you do not have legal work autrization.

You can take the above letter to your local USCIS office and explain that you will lose your job if you do not get EAD or iEAD.

This is not my personal experience, but I am just stating the experience of some forum members. All the best to you.
 
I got an EAD before 90 days. I got the current employer to write up a letter describing my job there and stating that my employment will cease unless work authorization is maintained. The officer also asked me to hand write and sign some reason why I didn't file early enough. The officer also said it's possible to get an EAD before 90 days for a "prospective" job as well. If you can't get a letter from your current employer, maybe you can find a "nice" person to write up job offer letter stating the same things.

Our office is in Phoenix. Here's the basic letter. You could probably remove the job duties. I added them in because I was going to use the same letter format as an AC21 letter. I made the INFOPASS appointment as "Questions about your case". Went there and got called up and I just said that I'm here to get an EAD and gave her my reciept notice. She calculated the number of days and said you have to come back on XX. I said my company is going to lay me off. She said you need a letter in that regard. I said, "Well....it just so happens I have one right here!!". She said ok and called CSC to confirm some info and ask some questions. She asked me to write up that "reason why you didn't file early enough" explanation. I just wrote, "mix up with lawyer", blah blah blah, and signed it. You may not have to go through that part though.

If that didn't work I was going to try using the "can't renew my driver's license" excuse. I did ask about that and they said it's not a good enough reason. If your dependant spouse or children need an EAD for driver's license renewal etc., you might consider bringing an EVL letter like yours if they're working or get someone to write up a "new job" offer for them.

EAD renewal

I just went to the local USCIS office today (in Baltimore). I have 10 days of lapse between EAD expiry and the 90 days. My card expires in 20 days. The lady (I secured the interview through infopass) did not want to budge on the 90 days. I tried several things with her. I told her i might lose my job, she said it shouldn't be a problem and I should continue working with no problem until the 90 days. when I asked her about a proof to show my company, she said that the Receipt letter should suffice.

My company's immigration specialist is not buying into that. She is saying that I have three days after my EAD expires and then they need to take me off payroll. I asked to get more legal opinions on this topic.

I appreciate anybody comments/concerns/previous experiences

That's whacked. The officer is whacked. How can someone work (legally) without work authorization? If someone knows otherwise, please let us all know! I would make another appointment and hopefully get someone else. Get a letter from the company stating that they will lay you off if you don't have your EAD. If they say the same thing again, get them to put it in writing and get their supervisor to sign it.

My ND too is 9/2003.
