How to File Tax While Working During the Asylum Waiting Period

I applied for asylum in June 2013, but still haven't received an interview notice. I obtained my EAD (work permit) recently during the waiting period, and I started to work in a Chinese restaurant. However, the restaurant didn't ask me to fill any employment form, and only pays me cash. I asked the boss (restaurant owner), and was told that I don't need to report tax. In my deep inside, I suppose that a good tax record would be beneficial to my asylum application and even the whole immigration process. If my asylum is difficult, maybe good tax record could more or less prove that I'm a good person and should not be deported. On the other side, I heard that if we meet a certain peiod of time reporting taxes, we would even be eligible to retire in the US. Therefore, I really want to file taxes, but don't know how to do that considering my situation. I hope the friends on this form could share experiences and offer advice. Thank you very much indeed, and all the best to everyone.

Your employer is practicing some questionable business practices. I would find another employer as soon as possible. Every employer is supposed to give to a W-2 or 1099 when the year end which will give you information on your yearly income and taxes withhold. Since you are working on a cash basis, (your employer is trying to cheat the IRS most probably), you will most probably not get a W-2 or 1099 from your employer.

As far as filing taxes is concerned, you will report the income you have received in cash up until 12/31/2013. Since your employer is not witholding any taxes, you will most probably have to pay to the IRS instead receiving a refund depending on how much you report in income. My advice is to find out if your employer will give you and document of your income and taxes withold report namely W-2 or 1099. After that meet with a tax accountant and they will be able to give you the best and qualified advice.

Thanks a lot! I just quitted the job today, and have located my 2nd job in another restaurant which would prepare tax forms for me. I really hope the waiting for interview period could end ASAP, so that I could continue school and my life. Just don't want to spend my life working in a restaurant washing dishes indefinitely. So sad!
