How to change non-degree J1 with HRR to H1-B or F1

Hello,
Currently, my visa status is non-degree J1 visa with HRR requirement. I would like to consult you that how to change non-degree J1 visa to F1 or H1-B. If I am in the process, how long does it take?. Furthermore, I will get a job in the next month. How can I get H1-B and How can I get 2 years requirement waiver? In this case, I really don't know about US legal. Could you please give me suggestions?

You cannot change your status to either F-1 or H1B.

You can leave the States, get F-1 visa and come back on it. It, however, does not free you from HRR. You cannot get H1B visa.

J-1 to H1B

Hi,

I also have the same status. I am research scholar at a US univ and I have my J-1 research scholar visa until march 2007. During this time I want to change my status to H1B. My 2 yr HRR waiver will be get done by the end of this yr. I want to secure Job before sep 2006 in order to come into 2007 quota. Do u think this will work in my case as I dont have any degree from a US university. And if yes then what will be the best time to start looking for job and file H1B.

what exactly do you mean by "this"? You have stated so many things in your post, it's hard to guess which part you are asking about.
 
j1 to b1

I am subject to two year HRR, I am about to leave to my home country and I am still waiting for my waiver from DOS. Can I go back to India and apply for a B1 without having waiver. Will I be able to come under B1.

Any reply in regards to this would be appreciated.

HRR doesn't prevent you from getting non-immigrant visa. It prevents you from getting immigrant visas, H1, L1 and K visas.
 
HRR and other question

I was hoping I could clarify two issues:

1. What is an HRR requirement?

2. If you have a J-1 visa that allows you to work after finishing school (in a training program), is it possible transfer to another job (a training program for the same position) during your period of employment?

J-1 Waiver

Hello!

Currently I am a graduate student in the United States. I have one year of studying left before I graduate. 6 years ago, however, I was an exchange student in high school on a J-1 visa sponsored by the U.S. Department of State. Now as I think about employment in the US, I found out I have to fulfill a 2 year HRR to get an H1B visa.
My questions are:
1) Is it practically impossible to get a "no objection" waiver from my embassy?
2)Does it make a difference what country you are from? I am from Ukraine.
3) I've stayed in my home country for 16 months, and, therefore, I have 8 more months to go? Does HRR have to be aggregate 2 years, or do I have to stay in Ukraine straight for two years without leaving the country?

I am not sure whether ti will be better to apply for a waiver while I still have one year of school left and the application and review process does take a long time.

Thank you for your help. =) This 2 HRR issue's been on my mind for the entire year.
 
Relax, it is not impossible to obtain a 'no objection waiver'. 2yr HRR can be an aggregate, does not have to be 2 straight years. Your best bet since you have just a year to go is start the application process for your waiver right away.
