How to cancel H4 ?

In strange situation need to cancel H4 while wife is India so that she cannot enter. We got H1/H4 visas in Chennai and things developed later so as I do not want to be bothered here and the bitter-half just wants to bother me here. How can I stop her entering the US. She has the originial I539 ?
 
If she is your wife, she has the legal authority to enter US on H4. If she is not, she does not. Figure it out yourself what you need to do.
 
hi there! i think we have a similar case, only i am the one with the h4 visa. neways, i just want to know from you guys if an h1visa holder has the power to cancel my h4 visa. the ins recently approved our I94 valid until 2005 but no visa stamping yet. i would greatly appreciate and ideas or data regarding this. thanks and have a good one.

Guys,

Do not bring or even try to contest divorce here in U.S. unless you want to get stuck with:

a) Her college tuition (if she decided to go to school) or pay any other debt she incorporates while living in U.S.

b) Or just flat alimony payments until she finds a way to support herself, which is not going to happen.

Trust me my very close friend got totally screwed by the court system. They are very sympathetic to women (specially to a woman from third world country like India ).

Don’t send your H1 approval notice, employer letter, recent pay stubs and I-129+LCA copy and all the pages of your passport.

The INS recently approved our I94 valid until 2005 but no visa stamping yet
--- You can remain in US till the time you have valid I-94 but if you go out you need the H1b holder papers, if he does not supply you then you will not be able to get H4 visa stamp and cannot enter US without H4 visa stamp

If the H1 says a divorce has been filed, then the H4 is gone. Especially vulnerable for people without visa stamp in passport (extension and people waiting outside US).
 
The poster did not post if divorce is filed, if H1b holder files for the divorce and H4 holder is in US, he/she has valid H4 till the divorce is granted by court, just filing papers for divorce by H1b holder does not automatically cancel the H4. Once Divorce is approved then the H4 status is no longer valid as it was based on H1b holder.
 
H1 can cancel H4 !!

H1 guy can write to the INS Service Center that issued the H1/H4, to cancel the H4 with the copy of H4. No questions asked. H1 is the primary sponsor of H4 and he can cancel it. This will work even if H4 has a valid I-94 in the passport. I-94 will not be valid in INS records, which is important. H4's stay becomes illegal immediately.
