How to cancel application?

Hi everybody!
I have send all forms to the KCC. Something happened so I can't move to the US permanently.

Is it late? I wouldnt like to endanger my further trips to the US (as a nonimmigrant).

1. What should I do now?
2. If canceled should I be filing on DS-156 : "Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?" - answer NO?

1) you can send a letter to KCC and tell them to stop the processing of your case.
2) you still have to say "yes", and then explain the situation.

Maybe if I wanna prove my nonimmigration intent, wouldn't be better to wait for my green card, travel to the US once and after that file I-407 ?
Will this act allow me answering "No" on that question on the form DS156?

On our US embassy , there are 20% denied requests of nonimmigrant visas. This is why I am scared anytime asnwering "Yes". Because I know it's important to show your ties to your country, I assume I-407 could be good proof.

Last question concerning the I-407.
Does filing this form reset everything? I mean for example: Say somebody is permanent resident nowadays. He will file I-407. Two years after he apply for a B visa. Will this guy be considered as everybody else who never had green card?

If your immigrant case is DV Lottery, I guess you may answer to that item "NO", because in lottery program nobody needs to petition on behalf of you and Lottery is a self petition program.
 
in DV lottery you file an immigrant visa petition on your own behalf, therefore, you need to answer "yes".

Last question concerning the I-407.

I don't know, but thinking logically it would be somebody who once had PR, but has formally denounced it.

This is incorrect. Entering the DV lottery is not an immigrant visa petition in and of itself. However, following up with sending the forms to the KCC or filing a 485 is. But the entery and winning of the lottery itself is not.

now it seems to be very confused for me

I would believe LucyMO because of her personal experiences.

But logically, no one has really filed petition on my behalf. And the question on DS-156 gives you two options:
"No / Yes (if yes write Who filed petition?)"

I understand that when I apply for a job in the US. (employment based GC) My US employer must file some immigrantion petitions ... but in this case :confused: :confused: :confused:

LucyMO , are you sure answering "Yes" ?

you should really read the posts carefully from the beginning before arguing - she already submitted DS-230, therefore, she filed an immigrant petition on her own behalf.

I am well aware that simple participation in the lottery is not considered "filing an immigrant petition for oneself". But that's not what her case is all about.

since you filed one of this, you self-petitioned. To be absolutely sure, please contact your local US consulate and ask them whether you need to mark "yes" on you non-immigrant visa application if you filed DS-230 but then officially abandoned all further processing. I do believe the consular officer will be more qualifed to answer this question.

I got a reply from Consulate.

I told them my problem as above.
And the answer is:

"Dear sir, write to the KCC that you are not interested in DV lottery. Tell them to cancel. Nobody made petition on your behalf, DV lottery is not the petition. Sincerely ... blabla"

On my long letter they answered these couple sentences. If they understood my problem, I would really answer NO on DS-156.
 
and if they didn't understand your dilemma?

print it out and have it with you when you apply for B1/2, if you decide to mark "no".... :) Good luck!
