Me and my wife have been married for about a year and a half before i sent out the forms to uscis in July.
How long have you been married before you filled? and does it make a difference the way INS looks at your case if you filled day after your marriage or 2 years later?

Most people file within 6 months, it does not matter much I'd think, as long as you have had plenty of time to gather evidence of the relationship.

a year

We just filed this week and have been married for 1 year. I have a TN valid until December, 2011 so we weren't in a rush.

Hello everybody,

I got DV2010 with CN of EU25xxx. I am an F1. I am planning to get married next week with my girlfriend. We have been together for 6 years now, the last two years being in seperate countries, but it is not a fake marriage. She is coming all the way from Turkey to get married here and apply for GC together, otherwise she will have to wait 6-8 years to get greencard by my sponsorship.

My questions are:

1)Are there any legal issues that may jeopardize the process with such a "quick" marriage? She is coming here for 1 week, we are getting married and she is going back until she finishes her school and then she will join me here in US. Will they say "hey wait this looks fraud?"?

2)Do we have to wait some time after getting marriage certificate or should we send our documents right away? I think we are already late because I hear that many people already sent their files latest by August. My case number is high (EU25xxx), so I am not really expecting to be current until May-June even July.

Trilpe Citizen: Thank you for your answer. And you even went through AoS, where they ask more questions about this???

Did you get married in the US or in Canada? Did you apply for greenncard or citizenship through AoS? Was your spouse a US citizen?

Can you tell me more about your situaution:)))

TripleCitizen:
Did you or your spouse change name/surname during the marriage? Did you face any problems when you applied right after the marriage because your name was still unchanged in all official documents and governmenatl IDs (passport, driver's license)? What do you suggest that we do about name change? Should my fiancee change her surname and apply with the "new" name or the old name because she won't has her new ID for a longer time and we don't want to wait before applying.

filed after 1 and half year of marriage. was tryin to time it in a way that when interview happens, shud have completed 2 yrs of marriage.

i personally dont think it matters when you apply.

My spouse and I both still use our birth names. I cannot advise you on the name change aspect. I personally do not believe in it and in my opinion it is just territorial. Pleases the minds of few :)

Thank you TriplwCitizen. Does anybody know anything about the name change policy during GC application? Should my fiancee change her surname and apply with the "new" name or the old name because she won't has her new ID for a longer time and we don't want to wait before applying.

I got married 08/15/2009 and I am sending all the forms this month (sept), ours is real and thats why I am not waiting plus i need my documents as soon as possible so that we can move out of this expensive state (MA) and start building our dreams. In addition I am pregnant and I want all this stuff to be sorted out by the time our babies arrive. It's already too much stress and running around and I can't imagine doing all of this with a new born to look after. Don't worry,, as long as it is real, God will honour you and there is nothing to be afraid of. All the best on this journey. You are not alone....

Connie

Thanks Conniewangui. I also live in MA and yes, it is expensive:) I and my wife (we got married today!) send the best wishes for you and your baby. Good luck.
We are planning to send our documents on Monday. Hope there is no problem in doing it this way.

No, but TheRealCanadian said "Since millions of people change their names at marriage, the system is quite capable of handling this", and it made sense to me because when I asked the people in the city hall, they said the marriage certificate has all the information (previous and current surnames). We just filled with the changed name, and attached the marriage certificate.
