How long can a conditional and condition free resident stay out of the US?

My wife works outside the US one a one year contract teaching. She left Jan. 8 and will return July 1 to maintain a less than six month duration outside of the yes. Is this correct?

How long does she have to be in the US when she returns before having to fly out again for her job? She is taking vacation time and needs to advise shortly.

She will be condition free in October 2010. Her teaching contract expires in late April 2011. When does she have to return to the US to maintain her status? I mean will it have to be in December 2010 or does obtaining unconditional status allow for a longer duration outside of the US? Just planning now incase I will travel to her instead of her traveling to me.

There is no set rules that say x-amount of time spent in the US = a resident and y-amount of time spent overseas = abandoned residency in US. It all depends on the interpretation of the I/O. If you (or your wife) come back to US for the sole purpose of taking advantage of that "up to 6-months stay is ok" practice, it can become a problem if you do it more than a few times. One time - I will say she will be fine. However, I would advise you to get her a re-entry permit, just in case.

I forgot to mention she received the I-131 Advanced Parole issued in March 2008 so we could visit her family. But that was before she received her conditional card in October 2008. Do you mean we need to re-apply?

She actually has two possible challenges. Firstly, to maintain her PR status. Secondly, if she spends too much time away from you, her I-751 may become a challenge too. Couples living apart in different states have had issues with their I-751s. If you both live in different countries, you may be asking for a close examination by the adjudicator.
