Hi,
I am on H-1B with a University, which is until May 31, 2008. I have been in touch with a company, who is probably willing to offer me a job. But before I start discussions with that company, I wanted to find out if I can submit a H-1 petition for a position start date say May 1st 2008 (i.e., around the time when my current university position ends)?

I understand that the application needs to be filed on April 1st...but is there a limit on how late the position start date can be ? That is, can I specify the position start date will be May 2008?

Thanks so much,
pd

Thanks so much for your reply. Since the filing needs to be done asap in April so that the quota doesnt get filled up, it looks like the position start date cannot be later than Oct. hhmmm...what a system!

you may be able to achieve what you want.
File new H1 on April 1 with Oct 1 start date without change of status or whatever way you won't get I-94 with approval. That way you are not required to start working on Oct 1.

Thanks...but could you please explain...I am not able to understand your suggestion.

I am currently on H-1B with the university and will be applying for H-1 with the company, (if I choose to accept the position). So this not a change of status, right..? So I am not able to follow you...could you please elaborate?

Thanks.

With change of status or extension of H1 or whatsoever, unless you get I-94 with approval, you can not work for the new employer. In other word, you can postpone joining new employer if you don't get I-94.
