How do lengthy overstays effect political asylum application?

Hi everyone,
I just found this forum while trying to find asylum information for a few friends of my sister-in-law.

Here is the situation: The guy is from Indonesia, was here on a visitor or tourist visa (not sure which one). He has been an overstay for about 3 years. He is a Christian and has stated that he is afraid to return to Indonesia because of conflict between Muslims and Christians there. The other person is a woman from Malaysia who has expressed the same concerns.

Anyone have any information about obtaining political asylum from these countries; what their chances are of success; and how their lengthy overstay situation would affect a PA application?

That not good but talk to a lawyer

International Institute or Able has them if cant afford one

that might raise a red flag in the Government eyes but that just my opiniokone
 
INS is at their door

Jut received another call from these folks. Apparently, INS has been to the woman's house looking for another overstay and in the process obtained all of her identity information. They advised her to wait for a phone call wherein they will give her an appointment to go to the INS office. The woman they were actually looking for is on her way back to her country I think...she hauled ass with her American-born baby who is only 2 months old.

Sounds like an interview for deporation....ya think?

I feel horrible for these people. I will try to find the International Institute or Able that was referred to in the previous post. Maybe they can help them.

And since when does the INS make house calls like this...seems very strange to me.

They probably received a tip that an illegal alien was living at the house. My mother applied for and received asylum after having overstayed her tourist visa for 2+ years. She is now a citizen already. So it is possible but you must have VERY compelling reasons for applying this late in the game.

Well, preferably, you should apply for political asylum within a first year from your entrance into United States. You still can apply after one year. At the interview you will have to show a good reason and come up with very convincing explanation why did you wait for 3 years to apply(and you will be asked about that!!) The overstay of your initial visa for so long could and mostlikely be the reason for denial at the time of interview and reference to the IJ (imm. judge).

I got asylum and I was out of status for 8 years. I was also arrested by USCIS who came looking for my younger at my home. If you decide to go to court, they will definately question you about the one year rule. You have to show that situations have changed for the worse in the last 12 months which will put your life in danger if you are deported to your home country.
 
Thank you all for your responses. I haven't talked to these folks since yesterday, but I have a feeling they are afraid to even try the asylum and are going to run again :(

I never realized how lucky we as Americans are until I met them.
