How can I withdraw F2 status / support?

Hi,

I have got married in India 2 years back and living in USA since then as a student(F1 visa). My husband too is in US currently, as my dependent(F2 visa). We are not getting along well together and it doesn't seem we can patch this up. We don’t have kids and neither do we share any property. I would like to file for a divorce(my husband is not of same opinion though) and seek your advise on following:

1) Is there a way i can withdraw my husband's dependent status (revoke F2 visa)?
2) I have requested my husband to grant a divorce but he is not cooperative and does not agree, lest his legal status be lost in US. Besides, he keeps threatening me and blackmailing me a lot. I do not feel safe and am not able to concentrate on my studies, feeling totally frustrated, helpless and lost. We do not stay together currently and i am not aware about his whereabouts. Can i file a divorce, irrespective of his opinion? Can he be forced to grant me a divorce?
3) What are the legal pre-requisites to get a divorce?
4) Once filed, how long does it take to get the divorce?
5) In case the divorce is not mutual and there is a no-show from other party what are the consequences?

Yes. As soon as you divorce him, his status will end.

Yes.

Can he be forced to grant me a divorce?

No, I don't think so, but I think but I am not sure that there might some provision in the law, that if the spouse is nowhere to be found, the divorce can be granted. Talk to a lawyer.

3) What are the legal pre-requisites to get a divorce?

Depends on the state. IN some a legal separation for a period of time is required.
4) Once filed, how long does it take to get the divorce?

Depends on the state.
5) In case the divorce is not mutual and there is a no-show from other party what are the consequences?

Thanks for your reply. By the last question i meant that i file for a divorce with him not agreeing to do so. besides, can you please guide me with the process. i am very new to all this stuff. i reside in Orlando, FL, fyi. thanks!

There are plenty of local law firms handle divorce case as little as $200.00.
