That is why I say we need to get united and ask the Ombudsman to help us by holding USCIS accountable. Please look at the NSC thread. We have received a response from the Ombudsman office and we need your cooperation to resolve this problem. Please go to the NSC thread and read Letter to Ombudsman thread.

Some members had got together and contacted Ombudsman office to make them aware about how NSC was using excuse of poor staffing and ignorance about number of files becoming current - so that they can slowly process cases. Well unless we inform the watch dogs, we can only suffer in silence or on complaining on this forum.

I tend to agree with banta4gc regarding old labors. My old labor and a bunch of other labors of my coworkers were stuck in backlog. These are now cleared but we were laid off and the co. was sold. No one is using these labors for anything. Basically all these labor approvals (and our money and efforts) have gone down the drain. If this is wide spread or not I do not know. If a sizeable number of labors will be unused it will create that much unused visa numbers. Lets hope for the best.

I have not one, but 2 such labors that got wasted (damn the early 2000 downturn). And I know the same thing happened to 4-5 other friends of mine...
 
Wow my respect to Ombudsman has grown multi-fold after seeing this document. Its like speaking our minds ...excellent find.

nyc: Don't understand your point. My post was meant for discussion and not predictions. My dates are already current right now. Re-read.
 
I seen in the report that around 23000 I 485 cases are pending which can not be approved due to immigration visa cap and not available of visa numbers. This number is total worldwide family based and employment based, refugee etc. It is hard to predict that out of 23k, how many belong to Employment based. My understanding is that most of the cases are of Employment based as in family based no back and forth movement of cut off dates.
Say for example, if 18K visa belongs to EB categories (EB 3 ROW, EB3 India/China/Mexico/Phili and EB2 India/China), it looks high figure to move cut off dates fast in coming months.

if there are only 23k pending cases, and you assume they are all EB and per the ombudsman report 40k visa's are unused, not making everything current is criminal!! Lives and futures are at stake here! EB3-ROW can be made current, and India can be taken past that 7% limit to reduce these backlogs. Come on Dept_Of_State, do the right thing!!!!

take my money USCIS. I repeat to USCIS 'TAKE MY MONEY'. Let me file I-485 and get a damn EAD. Sick of being stuck on just H1 for so long... I dont mind renewing my EAD annually for the next 3 years if thats how long the final step will take.

2. July bulletin may keep dates current or move them forward to clear pre-approved cases and avoid visa numbers loss.

3. Hopefully, USCIS will learn a lesson and not keep the dates excessively retrogressed in future.

USCIS needs to make everything current, take all the money and upgrade their infrastructure and also put the money in a bank to make more money for the next 3 years while they sort out the applications...:p :p
