Hello Ginnu,
I am planning to apply for AC21 as I am changing companies. My lawyer is charging $800. So I want to apply it by myself.
---file directly
is it risky to do it myself or is it better if I go through my Lawyer?
------ many have sent directly, lawyer uses the same info as posted on Sample AC21 letters( change according to your job duties)
is it ok if my salary is 12K less than that mentioned in my LC?
--Not a problem
Also, in your ac21 sample letter you have mentioned "(Attached for
your reference are relevant portions of AC21.)" what should I attach here?
------ USCIS officer knows what is AC21, if you dont attach no problem, send AC21 letter or future permanent job offer letter from your Employer+ I-485 filing copy+ 3-4 recent pay stub copy(better if you send AC21 Memo does not ask for Pay stubs it is just to make the USCIS know that you are working and being paid so that they dont ask more info in future)
Please advice.
Awaiting your reply,

---- what you need to do is take the LC approved copy with Form ETA750A and ETA 750B form(these forms are in LC pakage) take also your degreecertificates, education evaluation and all past exp letters then the lawyer will inform you if you are eligible to use that LC becase you need to have same education+exp BEFORE that LC was filed. if you are eligible to use that LC then let the employer file I-140,you file I-485,EAD AP

At what stage should I join company B??
---- It is better to be with B 3-4 months before I-485 approval, if go by law then after I-485 approval or any time. if I am not happy with A then I will join B only after I-140 gets approved or will join B with H1 transfer becase if I-140 gets denied then I-485, EAD AP all will get denied, it is better to be on H1 status till I-140 gets approved and I-485 hits 180 days
Thanks in Advance.
