Can some one suggest me on the following:

I came here on H1B visa and due to present situation my visa could not extend and even applied for F1 status but not could not be considered favourably. I am now staying unauthorized w.e.f. 04/01/2009 and my questions are -

a) I am trying to get married to a US citizen and what are my chances to get the my status adjusted. How long will it take ?

b) The other option would be, if I go back to India and then get married in USA to a US Citizen and then apply for I 131, what are the chances to get back to US as early as possible.

c) what are your suggestions and recommendations so as to get the status adjusted at a minimum loss of time.

d) Is it advisable to consult a immigration attorney to process my issue?

Appreciate if any one of you suggest best route to follow.

what do u mean your visa h1 cannot be extended ? Also if ur marrying for love u will get a work permit about 8 to 12 weeks and a green card in 4 to 6 months once you apply if you carefully follow things in these forums.Now if ur trying for paper marriage you get the work permit in same time but my friend your green card is going to be a real bumpy ride .. Good luck
 
Are you thinking of marrying a specific US citizen or any US citizen at the moment?

Marrying to a specific citizen who also come my country and fortunately her parents and my parents know very well . This fact I came to know after coming here. This citizen is a widower and also looking for suitable matches.
Appreciate if you can respond or guide to my concerns.

I am confused. You said "her parents" and then said "citizen is a widower"??? That does not make any sense at all.
Anyway, you can marry the US citizen and file I-485/I-130/I-765/I-131.

Marrying to a specific citizen who also come my country and fortunately her parents and my parents know very well .
 
I am assuming the citizen is a widow is what he meant.On the lighter side immigration process will be hilarious once they start legalizing same sex marriages.

Sorry for the confusion.
The fact is that I am (women) holding expired H1b visa and planning to marry to a US citizen ( male). He lost his wife 2 years back and now we are planning to get marry. Rest of the information is same.

Hope I am clear on this.

Marry in the US and file the forms I mentioned. You should be ok.

As we have decided to get marry asap, to do that I need to travel from my place from East coast to west coast to join him and then file the neceessary papers to get the marriage registered and then start the process of AOS.
Can it be safe to take air travel to do this? My concern will Airport Security will go stop, as I have show my Photo ID everytime to pass through security check.

Can someone guide me on this please?
