Help with Labor Substitution

I have Bachelors degree( 4 years of Engg. degree) from India and have 9 years of experience. My company have a preapproved LCA whose Column No. 14 of ETA 750A says,"MS or foreign equivalent (5 yr. of college)" and 0 years of experience,This labor was filled in may 2001 in SFO.
Can this labor be substituted for me ?
 
You don’t have MS so you cant use that LC and you have not written what is in column 15 of ETA 750A

col 15 says things like "Visual Studio, SQL, ASP" etc.. which i also know very well.
 
You don’t have MS so you cant use that LC try to find LC that is approved and has BS in 14 and matches your skills
 
My company is willing to Substitute Labor for me.
There is one unused Labor with exact skillset of mine but the problem is he got MS in July'99 and
I got mine in Dec'99. My lawyer says that you should have MS on or befor July'99 to use this Labor.

Is the same year degree not sufficient ? Is there
any way to get around it.

Any help is appreciated.
