HELP PLEASE?! US ESTA question

Hi all,

I would like to visit the US next month and I will be applying for an authorisation to enter the US via ESTA (VWP) tomorrow. I am an Australian passport holder for 5 years now. I am permanently employed in Australia and owns a house.

I was denied a visa (B2/Tourist) when I was still a Philippine citizen in 1997 (14 years ago).

Should I answer "YES" or "NO" in the eligibility question regarding US visa refusal (in the past) in the ESTA application?

What are the chances that I will be given permission travel?

from personal experience ESTA's are usually only refused on criminal record basis, I wouldnt lie on an official form especially where US customs is involved...

please note this is purely opinion

I currently waiting on my K3 visa an my lawyer has informed us NEVER to lie regarding visa's
 
I'll go with "yes". Just don't lie to them. There will be time that they will detect it if you do. So just be practical and answer what is needed according to your preferences. ;)
