Help Please If Anyone Knows

Hey guys.

I hope that someone will be able to help me
I applied for citizenship back in July, received an appointment for my fingerprints on September 13th and then went to Israel to see my fiance on September 20th (stayed there for 5 months). We (my fiance and I) came back to the US in March (i already had a letter from USCIS with my appointment date for an interview). We got married and he went back to Israel and i stayed waiting for an interview. All of a sudden i received a letter from USCIS that due to unforeseen circumstances my appointment is cancelled. (i already know why "file didn't get to them on time")

My question is: Can i leave US for another 5 months to be with my husband or since i already was out of the country for 5 months i have to stay and wait for another interview date?

I would advise you to stay, as leaving for another large amount of time would indicate that the US is not your primary residence. Especially if you just got married and are going back to your spouse's home country for extended periods of time. The 5 months out might already be a red flag, so have your spouse visit you back and forth till you naturalize.

You are almost at the end of the journey, so just wait it out and try to have a semblance of a permanent life here in the US.
 
One long trip under 6 months is ok.
Two back to back long trips is pushing your luck.
A spouse living in the country you are making those long trips to, is really going to push the IO over the edge.
 
just curious.. why was your appointment for an interview cancelled? did you request to postpone the interview?

I suggest you should stay in usa until interview and oath are completed. if you are going out of the country again for 1 or more months (plus 5 months that you already stayed in another country), your n-400 application will be denied. Just take it easy. You are almost done.
 
thank you guys very much for all of your help.....i talked with my attorney (i work at the law office but don’t like to ask them for help since i am not a paying customer) and he basically said for me to go to the original interview date pretend that i never received a cancellation letter and he will try talking to them as well......so i am hoping that everything will be over soon.....its just very difficult to be away from my husband for such a long time, specially when he is in the Army

oh and another thing, i have been a permanent resident for 12 years already and for the first 9 years never left a country......does it somehow helps if i do decide to leave?

So your attorney told you to go to canceled interview anyways? Without your case file at the DO how will they be able to conduct interview???
 
well the reason that he found out why its canceled is that my last name is the same as someone else's who has a criminal past but my father is sheduled for the same day as i was and his appt wasn't cancelled so he (my atterney) wants me to go and he will come with me to see what is going on.......he also said that usually the file gets there only couple of days before and there is a chanse that it will be there waiting for background clearance which might take a long time........but he had cases where his clients went (while their appts were cancelled) and took the test anyways........so will see what will happe........i can only hope for the best

Are you sure that the files only get to the local DO only two days prior to the interview? How do they have time to send a letter of cancellation just two days before the interview date?

well cancellation letter is usually sent from a main office.....not the local one.....and cancellation letter is usually sent 2 weeks before the actual appointment

I don't see anything wrong you appearing for an interview pretending that you never received a cancellation letter for your upcoming interview. You don't have anythinng to loose, may be few hrs at the DO if they send you home. Since this is a naturalization interview and what I have heard is, if the background check is pending the officer will not interview you coz they are trying to avoid applicants filing law suit 1447b if they have have been interviewed and the decision has not been made. In that case USCIS will have 120 days to make a decision and that puts a pressure on them. Just keep this in mind I guess.

Hello guys
Just wanted to let you know that i went to the USCIS local office today for my interview which was cancelled (i decided to go anyway) and they took me (even thought my file wasn't there) and i passed the test......so, to all of you who's appointment has been cancelled due to unforeseen circumstances: don’t give up just go there and try to do it anyway, it might work :)
