Hi All,

I naturalized in Aug 2010 and my wife is still on Green Card ( still not eligible to file for naturalization as she had couple of long trips outside US ). I am planning to move to Asia for a few years and wanted your inputs on my wife's situation. Should i surrender her green card and get a visa and then file for her naturalization when i eventually return to US permanently ?. What are my options ?.

Appreciate any thoughts.

It would make a BIG difference IF your reason for going abroad qualified under INA 319(b) or (e) for her expedited naturalization. OR IF she had qualifying employment under INA 316(b) or (c), 317 or 319(c). They may be longshots but otherwise make sure she gets re-entry permit(s) before departing.

What about what your wife wants to do? why cant you wait for her to get her citizenship too before you move somewhere?

She can apply now with the 4 year + 1 day rule. She should stay in the US until she completes the oath (with nothing more than short trips abroad before the oath), and then join you in Asia after completing the oath and getting her US passport.
