Help on H1B to TN (1st time)

My 6-year H1B will expire this Aug and I need to change to TN. Just talked to my company's lawyer and she said I'd better go to border since it will take a year to process for mail-in application in Texas Center. I'm in North Carolina and I thought I could mail my application to Vermont Center. Can anybody have this information (preferrable with official link)?

BTW, how long do you guys wait in average if you submit your application in mail? Thanks!
 
One more question, if I submit TN application now, when my H1B expires in August but I haven't received TN approval notice, can I work at that time?

Your lawyer is clearly out of the loop when it comes to TN, so take what she says with a mountain of salt.
If you don't want to go to the border, you may file an I-129 to get TN, it will be sent per the instructions on the current form. Its taking about 3 months right now. uscis.gov, which you should be familiar with given you have had H1 for 6 years.


Now, to avoid any lapse in work authorization, you will need to get approval before your H-1 expires. You need the approval to work in TN, no grace periods. So, you might consider premium processing for an extra $1000. So your looking at$1300 in fees to ensure you get it in time.

Other wise, simply plan to go the border (any border) at some point between now and August and get TN.

So should I mail out the application package or the company's lawyer? one more thing, when you guys renew TN, you still send mail-in application to Vermont?

Just out of curiosity, what kind of TN application goes to Texas Center?
 
There is only one place to mail TNs: its on the I-129 instructions, which you've read by now, right?

Yes, you should stuff the lawyer into a box (with air holes) and mail her as far away as fedex will take her. far away from anything to do with your application.

Currently nothing. All TN mail-in applications are processed at Vermont. It is clearly stated in I-129 instructions.
