What Ginnu says (Canada Visit) is the simplest solution for you. The goal here for you is to get new I-94 for your wife at border post which can be any one. Good thing here for you is that your wife got her passport revalidated with new visa.

I was not aware of I-539 for H4 extension either. The only difference is that I came to know about my wife's expired I-94 in last few days before my planned visit to India and it was expired more than a year.

So, after understading the actual problem (of course, thru' this forum) and lawyer's consultation (who suggested to file I-539 and get ready to appeal if I-539 denied) I decided to go ahead with planned trip to India and entered back after a month. Got new I-94 for whole family without a question. (Still don't know if it has any repercussion in future or not, but that's a different story).

So don't waste any more time and plan a visit to Canada or India.

Thanks a lots for your help. Sent my wife to India. We preponed her India trip by 8 weeks. Her I-94 was removed from her passport at the Newark airport. However she could not keep her boarding card as officers in Mumbai did not allow her to keep it.

Now I hope things will be better when she is back. I will update once she is back - never know someone might need this info. Only thing is that I may loose some days on 140/485 filing.

Ginnu - you are welcome for sweets whenever you come to NJ. For that matter all four of you are welcome.

OK here is the update:

I sent my wife and kid to India(preponed her schedule.)

She was relcutant to go to Canada - what if something goes wrong? Apprehensions were fair enough. So got in touch with a travel agent in NJ and got tickets to India thru Air India.

While her way back, she entered thru Newark Airport, NJ . She got her new I-94 without a hitch - process was smoother perhaps due to the fact that the immigration officer was a desi.

Good to know that your wife is back to NJ with new I-94 and is in valid status. Do you think I need to visit NJ for sweets? US has Postal service also..................
