Help Needed - Job change during adjustment of status

Hi,

I am working in a company based in St. Louis, MO. I am getting an offer in a company in New York. I have been on EAD since November 2002. I got my I-140 approved in October 2002. The receipt date for my I-485 is February 2003.

My job profile stays the same as mentioned in the Labor Certification. But my salary is increased from whet I was getting in St. Louis.

I would like to understand regarding the following:

1. Will it impact the processing of Green Card because St. Louis falls under Nebraska where as New York is under Vermont?

2. Will my files be moved from Nebraska to Vermont? Will they carry the same priority date?

3. Is the AC-21 issued in St. Louis good for New York also?

I am supposed to tell yes/no to the company in New York in couple of days. Earlier they did not think it is an issue to move the GC process. Now they are debating if it will have any impact.

ANY HELP ON THIS IS GREATELY APPRECIATED.

Thanks
Vriksha

1. Not every case will get transfered. Sometimes your case might be transfered to the local CIS office, when you will be called for interview depends on the backlog at the local office.

2. In the case of your file getting transfered to VCS, you may get your approval faster since VSC is already doiing June 2003.

3. It is not mandatory you file AC-21. If you get RFE for EVL file AC-21 with employment verification letter from your employer in NY. Increase in salary will not impact your approval in negatively.

Go for NY.

Hi armie,

Forgot to clarify on the priority date. If the files get transfered ti VSC, will the priority date change?

Thanks
