Hello Guys

I have received my favorable Recommendation from DOS in Aug 2005 but till now my case is pending at USCIS.. as of date Vermont centre is processing cases dated July 2, 2005 :( gosh there seems to be too much backlog at Vermont!!

any idea how long will it take me for the final approval? can i get my status changed from J1 to F1 since i'll be out of status by dec15, 2005.. please guide me..
 
i think you might be able to change to H1 with the DOS approval. I am not sure what happens to the cap issue though.

You may legally file form I-539 ‘Change of visa status’ (in your case from J-1 to F-1) if you have only DoS favorable recommendation. USCIS will issue ‘Change of visa status’ approval notice in the same time with the J-1 waiver approval notice (I-612). I was in the same boat when changed status to H-1B last year. Good luck!

Pay attention that J-1 holders may stay legally in the country extra 30 days after expiration date mentioned in the DS-2019 form (this is so-called 30-day grace period or voluntary departure period). However you cannot work during this time (only travel, leisure, fun etc.)

Thanks a lot for the info! can you please let me know the detailed procedure and the steps to be followed while filing for form I-539 ‘Change of visa status’ (from J-1 to F-1)?

Do I need to hire a lawyer for it? Any scope of denial? how long does it take for the transfer?

IMHO you need first to find University or school which will issue I-20 form for your F-1. For example, it may be the same university which issued your J-1 visa. You don't need a lawyer, usually an international office at University files documents for change of visa status from J-1 to F-1. If you need more details on change of visa status from J to F ask LucyMO, she had such experience. I never had F-1 visa. Good luck.
 
chances of rejection while stamping in india

thanks a lot! finally today I have recd my I-797 from USCIS.. if I manage to get admission into any university and go for a change of status from J1 to F1..how long does it take for the transfer..while still being in US..

can I make a trip to india once the application for adjustment is filed with USCIS? I understand that I need to do the stamping from India even after the status is transferred to F1.. Is there any likely chances of a rejection at consulate in India even though i happen to have an I-20 & my status is F1?

from J1 to F1

I don't think you must have a waiver to switch from J1 to F1, though you already got it. However, back in 1996, the LSU made me to leave the country to come back with F1 visa in order to stay in school after one-year J1 program expired and I got accepted as a regular student. So, I had to get that done in Mexica. I don't remember many details, but the international office at the LSU was pretty sure that I can't change my status from J1 to F1 while in the country.

Can somebody share exactly what should the online status show after the "sponsor views" item has been received and the waiver decision is made? Is it something like "212(e) Finding Letter" sent? And then, in a week or so the decision should switch from Pending to whatever?
 
J1 to L1B

hello,

can anyone help me... My company is ready to sponsor my L1B visa but got to know that they are a little hesitant & apprehensive of my scope of rejection on the grounds that I was sent to US by the same company on J1 visa (with 2 HRR) and now again change of status to L1B.. They fear that they may be brought to scrutiny by the consulate

My Question is will conversion of J1 to L1 have any sort of negative impact both on the company and my own case file?

Can I apply for a change of status to L1B right here in US? for stamping is it mandatory to return back to my home country or can I go to Canada/Mexico to get it stamped
 
FORM I-539 from J-1 to H-1

Hello, I've done my research on the entire forum...and I haven't found any information on how to file form I-539 "change of visa status" from a J-1 to an H-1....Do I need a lawyer??? Anybody has any experience on this matter??
 
As Streamflow has mentioned above, you cannot file I-539 by yourself for change of status from J-1 to H1. You will need a sponsor e.g. university or company etc who will file it for you. Their international office will handle the paperwork.
