Help me with this, please!!!!!!!!

My husband whom I brought to this country on K1-visa left me six months after his arrival. Six months later the INS sent a letter for us to show for the interview. Nobody showed up, that was a year and half ago. I have never received anything from the INS regarding this case. Now I found out that my husband hires a lawyer to help him getting his green card thru me without my involvement. Please tell me if is it possible. Thank you, any reply will be greatful.

you should. What visa did he come on: K1 or K3?

If K-3, he will be able to get his GC through employment or DV lottery visas, but not through you.

I'd file for divorce and get it. There was most likely a deportation order for him somewhere out there, since you never showed up for the interview.

thank you for replying, he came on k-1 visa almost 3 years ago.
 
he will not be able to get a GC based on marriage unless you go with him to the USCIS and tell them the marriage is genuine, etc. If you divorce him, he won't get a GC even if he marries some other US citizen.

In any case, if you have his complete name and number of his case send a letter to USCIS advicing that you are filing for divorce. File for divorce and sent a copy of the file so they know that he can't bring a person with false identity or whatever.

I'll be going in person to the local INS office to straight everything out just in case he's planning to do anything like that. I am about to file for divorce. thanks again for your help.

I went to the local INS ofiice to find out about the case ,well they wouldn't give me any info but I was told that the file has been transfered to Vermont. I did my own investigation, I found out that my husband filed a self petition (I-360) claiming battered spouse in order to get his GC. I would like to know if the INS will just take his words because he doesn't have any documents to support his claims. If there is victim in that whole mess, that will be me. What can I do?

Please tell me if is it possible.” I would have to say that YES – it is very much possible for your ex-husband to get GC even without you going to interview with him. I know a person who did just that, with a help of experienced (sleazy) lawyer.

Unfortunately – If you do or say nothing then INS will take his word for it and grand him a Green Card.
What you can do:
1) file for a divorce ASAP. You can do it even if you don’t know where your ex resides or if he refuses to sign the papers. Just go to the court and file.
2) Send a letter to VSC addressed to Paul Novak (director) explaining your situation with your ex-husband. Include copies of your divorce petition and all other information and receipt you have on your husband.

So Immigration even don't need a police statement or something? I just was reading about it...is totally his word against yours. Plus you can file for divorce but apparently that won't affect too much. Write everything you can to USCIS explaining your situation and timeline because then your name will be in the dark list.

Hey, can she file for divorce with emphasis on fraud on his part or lying to her or something like that?

Thank you for all your supports, I have never been invloved in anything not even a parking a ticket. First of all, in order for him to be eligible we have to live together for at least 2 years and be in the america for 3 years. I am going to do everything I can to stop this nonsense.
 
Sorry to hear about your case, I knew the only way he can do is to file for battered spouse. Even verbal abuse counts. I don't know what happened between you two, what makes he left you after 6 monthes. I mean obviously he wants the Green card, his leaving put him in a extremly difficult situation. In some tricky cases, even a recorded type of yelling would counts as evidence. But I don't think the immigration officer will just give him Green card without investigation. I bet they will find you and ask questions or you can just call in to ask them. Just be careful and honest to answer them if any questions. take it easy~

Not every abuse gets reported to the police. He, as a man, might say he was ashamed or scared and didn’t know about the laws in this country. He might say Olympia harassed and verbally abused him, or took advantage of him. Lawyers deal with cases like this on a daily bases and for the right prize, that one that Olympia’s ex hired, might give him some good points on what and how to write to win this case.
I really hope Olympia will get to the truth and deport that bustard.
They been separated for sometime now – this alone is a good reason to file due to “irretrievable broken marriage”
