help: I-94 question

I have a I-94 card issued when I entered with F-1 visa. Now I have another I-94 issued when my H-1B was approved. When I leave USA for travel, which one should I submit, just the new I-94 or both of them? Or neither of them? Thanks a lot!

In my opinion, the latest I-94 is your actual I-94 at any given time. So you should submit the one that you got with your H-1B.
 
You need to submit both ur I-94's, you will get a new one when you enter the country on H1B visa. Also, since you are switching frmo F1 to H1, you need to go to the consulate outside US and get the H1B stamped on your passport.

I plan to travel on AP instead of going to apply for H-1B. I heard people being checked for H-1B visa application. Once being checked, I probably can't enter US even with AP before the checking is cleared, can I?

If you are on F1 and have started working on H1B, then you NEED to get it stamped in India before you come here again into US. If you dont have a stamp, then you would be sent back in the next available flight.

Only when you have the new H1B visa stamp, you would be allowed.

You are taking a great risk.

Want_GC_Soon, are you sure I need H-1B stamp? I currently have Advance Parole, and plan to use it to enter US instead of H-1B.

I saw a case at the airport where a guy initially came exactly like urs and didnt have a stamp , but started working on H1B and tried using AP.

The immigration officers first question was why he didnt stamp it in India during his visit. He asked him to make travel arrangements to travel back to India.

I was at the scene for around 30 minutes and he was checking with airlines to see if he could take a connecting flight to India.

Immigration Officers dont appreciate us entering without stamping especially when we are changing status from F1 to H1.

BTW, Can I know why you dont want to get your visa stamped in India?

I am working on H-1B now. I have a friend who tried to obtain a H-1B visa stamp but was background/security checked. He waited for 9 months for the background check to be cleared. That is why I plan to use AP instead of applying for H-1B stamp.

But your story seems scaring! My attorney never warns me about it.

AP guarantees you entry into US, if you havent started working on H1B visa before leaving US. But if you have already worked on H1B then without getting your new stamp, the Immigration Officer would definitely send you back.

I have seen a case in front of me, where he was sent back even after repeated pleading.

I advise to get it stamped in India rather than to see surprises/shocks when you enter back into US again.

Better get the stamp or you would definitely see shocks/surprises at the port of entry.

Its just random sampling to get H1 visa from F1.

All rules pertain to all countries(including China as well). If anyone has started working on H1B after changing their status here, and if they leave US and try to come back, they should enter with their new H1B visa stamp.

This is very clear.

I checked with a lawyer about this issue and his answer is a big NO to what you have said.
If possible, can you please check with your lawyer about this issue? I would greatly appreciate that.
