Hello All:

Here are my questions:
1.I lost my receipt notice for I-485. I don\'t have any photocopy. What should I do? Someone said I would never get the replacement receipt notice from INS if I simply write to them to ask for it. So what would be a better way to help me out?
2.Currently, I didn\'t get any info from INS after I filed my I-485 on 12/21/2000. How can I get info on my pending I-485? If there is no quota for me to be adjusted to PR, what should I do with it? To file another I-485?
3.I want to leave USA for an emergency travel. Is there any same-day AP processing at INS New York Local office? If so, what kind of document should I bring with me? Since I already lost the receipt, what should I do to prove my current legal status in USA?
4.Can I ask a lawyer to find my info on my I-485 with the INS local office? Can the lawyer find out whether my pending I-485 is hopeful or not? If I have to face the denial of my application, what should I do next?
Can I ask the INS to return to my F-1 visa? I\'m currently a student.

Your assistance is highly appreciated!!!!!!!!!!

Ask a copy of 485 from Lawyer

Usually Lawyer will receive original 485 receipt. May be he sent you the original after taking photocopy for his reference.

some more options...

1.Yes true. you will not get another receipt notice. But you can send a fax enquiry and get the receipt number , alien number details back by fax. Better yet, ask a lawyer to do this.
2.Is it family based adjustment? You can call INS and use your SSN to find your receipt number, A# and status of application. Many immigration lawyer sites have processing times - see the latest visa bulletin. You need not apply another 485. If your PD is current then your 485 will be Queued up for approval.
3.Without a receipt most of the local office will not issue AP. See the field office link in INS web site for NY office. For family based 485s AP is usually a walk in. For employment based 485s you have to apply AP by post first before trying with local INS.
4.Local INS cannot help you in this regard. If denied and you cannot prove that 485 is pending, you will be deported.
5. If you are a student- are you using EAD? You cannot go back to F1 just like that. If you go you will abandon your GC and might not be allowed to apply for GC again. If you have EAD, you can find the A#.

canceled check

On Sheela Murthy\'s site in the last week or so, she said in lieu of the receipt notice, you could obtain a canceled check/copy of canceled check. This will contain the A# and the receipt/notice # that you then need to show to the local office. I hope this helps. Good luck.
