Hi All,

I would provide my background.

1. April 2001 H1B was applied by employer ABC
2. H1B approval came in June 2001
3. Got laid off in Jan 26th, 2004

4. Jan 30th, 2004 applied for H4 based on my wife H1

5. Now I am planning to do my H1 through a staffing service

Question:
1. Can I do an H1 transfer ? or the staffing service has to do a new H1 ?

2. Should I go for a Premium service ?

------ Employer has to file Change of status from H4 to H1B

----- YES file COS through premium processing immediately

Thank you for your help. I have couple more question

1. Would my H1 be subject to current quota ?
2. When I file for my H1 and since my H4 is with INS do I need to do inform INS that cancel my H4 application or anything special about it.

----- you don’t request for cancellation of H4 when you file for Change of status I hope you understand the meaning of CHANGE
