Help filling out I485

Hi All,
I am a GC holder soon to be a Citizen. I have filed I-130 for my husband 2 years back who is on H1 right now. On form I-485 Part 3 Ait says "Have you ever before applied for permanent resident status in the US?" What should I answer? Should I answer "Yes" since I have filed I-130 for him??

You're not filling it out, he is. Has he ever filed an I-485 before?

So did u get your oath ? when is it ?
I am getting ready for the DORA from Dallas.
My oath is on March 10,2005.
We have not yet started filling out the 130 or 485 or anything.

few questions regarding filling out of 485.
On page 2, part 3 (Processing information), what do u write in the nonimmigrant visa number. My husband is currently on H-1 status but he has not yet got it stamped. the only visa stamped on his passport is the student visa.

Also on 130, on page 1, part C ( info about your relative), for item number 14, date arrived. here do you have to write the date when first arrived to USA or the date of the most recent entry ?

my husband first arrived in Aug 2000 on student and then he made a trip in june 2002 again on student visa. after that he changed to H-1 in 2003 and has never made a trip outside US since then..( thats the reason H-1 is not stamped).

Regarding this, I will check my copy of I-130 filed at home and let you know tomorrow. But I think I have wrote last arrival date.

so u mean the control number from the passport's visa stamp ?

I am also not sure, just for safety try to get a transcript of last 3 years from IRS. Thats what I will do reading from the other forums. they say that u can get a transcript in about 10 days. I will order mine today.

and yeah.waiting for u to check the date of arrival on ur I130....

If I ask for my transcript like in a week or so they won't have my 2004 tax returns listed right? I want 2004 Tax return taken in to consideration because otherwise my income was very low for previous years. So is that ok if I submit transcript for previous 2 years and a copy of returns for year 2004?
I mailed my tax returns for 2004 yesterday.

I think even the 2004 W-2 and a copy of the return u mailed should do.
 
Amishah,

I don’t know how long it will take for your 2004 transcripts to be ready.
As soon as IRS processes your return they should be able to provide you with one.
From my personal experience (from a date I filed tax return to the date refund check was issued)
it takes them about three weeks.

Also, when my husband filed his affidavit for me we included copies of his past tax returns and most recent W-2. INS accepted tem.
Later I ordered tax returns (just in case) and I keep them for the interview (looks more official, I think).
So, to answer your question – the copy of your last return and W-2 is fine.
