Help: F1 Married to US Citizen

My wife is currently on F-1 student VISA. I am an US citizen and we got married a couple months ago. If I start the green card application for my wife, does my wife's F1 status will be changed immediately? What effect will it bring to her after the change? If someone know something about this please help me out . Thanks a lot

F-1 status becomes void at the moment you get a receipt for your filed applications. From that moment her status will be "AOS pending". She will be able to take classes as much as she wants - there's no restriction on that. She can choose not to be enrolled full time after you file for the adjustment of status.

I had a valid F-1 when we filed for my green card, and I let our DSO know. She had no problem with that. I also had an on-campus job at that time, and I told the HR department that I was filing for AOS. However, they really didn't care and they let me work for as long as my I-20 was valid. So, go figure :)

Hi:

After filing AOS, your wife's status will be PENDING AOS. Her I485 receipt is proof of this. She can continue to study, stop studying or drop to part-time studying. She should use AP parole to travel if she is eligible, and NOT her student visa. Technically she would require EAD to work on-campus, but this is rarely enforced by on-campus employers. In any event, unauthorized work is forgiven to the spouse of a USC.

just tax forms, if you wish, need to be revised, and if you get insurance through your employer and wish to add your spouse to it as a dependent. Other than that - no.
 
hi, I have a related question.
I was holding F-1 and same here I send out I-485 family based.
Since I go to a state university, I am wondering when I can start counting as a in-state student?
After I receive my green card? welcome letter? interview? interview letter???? :confused:

since my school's international student office know nothing, I thought maybe I can find out by myself and tell them.

you would have to ask the financial aid office or a registrar. In most states, in order to qualify for in-state tuition, you would have to be a resident of the state for a year. In order to become a resident of the state, you'd have to be in immigrant status (that is, have a GC for a year and still live in that state). Some states allow H4 holders to pay in-state tuition.

Do a google search on your state's definition of a state resident for tuition purposes. Oh, and by the way - if you want to pay in-state tuition after that first year, you cannot go to school full-time during the first year - only part-time.
